<br /> <br /> <br />MEMORANDUM <br /> <br /> <br />To: Honorable Mayor and City Councilmembers, City Manager Mark Casey <br />From: Molly Just, AICP, City Planner <br /> <br />Date: City Council meeting on February 12, 2019 <br /> <br />WSB Project No. 011104‐00 <br />Request: Ordinance to amend certain sections of city code related to decks <br /> <br />RECOMMENDED MOTION <br />Motion to deny the enclosed ordinance to make changes to the provisions for decks in the City Code. <br /> <br />CONSIDERATIONS RELATING TO THE REQUEST <br /> <br />Based on an administrative appeal to staff’s interpretation of the regulations applicable to decks, the <br />Planning Commission directed staff to prepare an ordinance relating to and regulating the setbacks for <br />decks. <br /> <br />What follows is a timeline that depicts the consideration of this matter: <br /> <br />9/24/18 Planning Commission work session to discuss text amendments including an alternate definition <br />for decks and a provision for decks to encroach into setbacks. <br /> <br />10/22/18 Planning Commission public hearing and recommendation that the City Council adopt the text <br />amendments. <br /> <br />11/13/18 City Council discussion of the text amendments and referral of the matter back to the Planning <br />Commission to provide clarity around potential privacy issues due to deck placement in setbacks and <br />reconsideration of how this meets a greater public purpose or is it designed to address one situation. <br /> <br />1/28/19 Planning Commission work session to discuss the need for the text amendments. The Planning <br />Commission recommends that the City Council not adopt the zoning language as there is not a greater <br />public purpose that would be served in doing so. The proposed text changes were only proposed <br />because of an administrative appeal following denial of a variance for construction of a deck within the <br />setback. <br /> <br />31
