Z <br />VARIANCE REQUEST FOR 3713 33rd AVE. N.E. SAINT ANTHONY VILLAGE, MN <br />107 SAINT ANTHONY — LAND USAGE <br />(1) THE SUBJECT MATTER OF THE APPLICATION IS WITHIN THE SCOPE OF THIS <br />SECTION. <br />The subject property 3713 33rd Ave. N.E. is located within the St. Anthony City Limits. <br />(2) STRICT ENFORCEMENT WOULD CAUSE PRACTICAL DIFFICULTIES BECAUSE; <br />Unsplit Subject property is 17,100 sq /ft <br />(a) THE PROPERTY OWNER PROPOSES TO USE THE PROPERTY IN A <br />REASONABLE MANNER NOT PERMITTED BY ZONING CODE; <br />lot 1, with 7,000 sq /ft meets St. Anthony building codes <br />lot 2, with 10,100 sq /ft is short 990 sq /ft requirement for a corner lot, note there <br />are many smaller lots within a 6 block area (please see attachment 1) <br />(b) THE PLIGHT OF THE PROPERTY OWNER IS DUE TO CIRCUMSTANCES NOT <br />CREATED BY THE PROPERTY OWNER; <br />Current sq /ft of subject property is 17,100 <br />(c) THE VARIANCE, IF GRANTED, WOULD NOT ALTER THE ESSENTIAL <br />CHARACTER OF THE LOCALITY; AND <br />With 2 new homes the new project would upgrade the area and remove a 1904 <br />Farm House and a dilapidated Barn <br />(d) ECONOMIC CONSIDERATIONS ALONE ARE NOT THE BASIS OF <br />PRACTICAL DIFFICULTIES <br />Difficulties arise from the city's building code that requires 11,000 sq /ft for a <br />comer lot, note with the addition of 2 new homes it will also increase <br />real estate taxes <br />(3) THE VARIANCE, IF GRANTED, WOULD BE CONSISTANT WITH THE CITY'S <br />COMPREHENSIVE LAND USE PLAN <br />The project would provide updated single family housing in an older <br />neighborhood <br />(4) THE GRANTING OF THE VARIANCE IS IN HARMONY WITH THE GENEERAL <br />PURPOSES AND INTENT OF THE ZONING CODE <br />If only 1 lot is allowed it would reduce any advantages for optimum land use <br />and will not maximize the city's land use plan <br />Respectfully submitted, <br />Walter B.
