City Council Regular Meeting Minutes <br />February 12, 2019 <br />Page 3 <br /> <br /> <br />Motion by Councilmember Jenson, seconded by Councilmember Gray, to approve Resolution 1 <br />19-011; a Resolution denying a lot split with variance request for lot size on a corner lot by 2 <br />Walter Sentyrz at 3713 33rd Avenue NE. 3 <br /> 4 <br />Motion carried 4-0. 5 <br /> 6 <br />VI. GENERAL BUSINESS OF COUNCIL. 7 <br /> 8 <br />A. Planning Commission’s recommendation regarding proposed deck ordinance. 9 <br /> 10 <br />City Manager Casey stated based on an administrative appeal to staff’s interpretation of the 11 <br />regulations applicable to decks, the Planning Commission directed staff to prepare an ordinance 12 <br />relating to and regulating the setbacks for decks. The timeline that depicts the consideration of 13 <br />this matter was reviewed by Mr. Casey. Staff recommends the City Council deny the ordinance 14 <br />to make changes to the provisions for decks in the City Code. 15 <br /> 16 <br />Councilmember Jenson asked if decks are considered against the 30% rule. Councilmember 17 <br />Jenson also asked about item G and if that means if the criteria was met could the deck take up 18 <br />an entire backyard. 19 <br /> 20 <br />Mayor Pro-Tem Stille stated one applicant was trying to be accommodated and due process was 21 <br />followed. Two planners reviewed this and the recommendation not to move forward was evident. 22 <br /> 23 <br />Motion by Councilmember Gray, seconded by Councilmember Jenson, to deny Ordinance 2018-24 <br />01; an Ordinance to make changes to the provisions for decks in the City Code. 25 <br /> 26 <br />Motion carried 4-0. 27 <br /> 28 <br />B. Silver Lake Management Plan Update. 29 <br /> 30 <br />Mr. Tony Havranek, WSB Sr. Environmental Scientist, presented a review of the Silver Lake 31 <br />Management Plan covering existing water quality, fisheries, and vegetation data; herbicide 32 <br />applications; TMDL implementation activities; stakeholders’ issues and goals; and, the status of 33 <br />the plan document. It was noted the project partners were: City of St. Anthony Village, City of 34 <br />Columbia Heights, City of New Brighton, Rice Creek Watershed District, Three Rivers Park 35 <br />District, Silver Lake Homeowners Association, Ramsey County Public Works, MN DNR and 36 <br />WSB. 37 <br /> 38 <br />Councilmember Gray stated it appears that removal of the carp caused the weeds to grow out of 39 <br />control. Mr. Havranek stated that was one component in addition to many improvements made to 40 <br />water quality. The Secchi data was taken over many months and the key is to balance the 41 <br />components. 42 <br /> 43 <br />Councilmember Jenson referred to the flood mitigation project next year which will divert water 44 <br />from going into Silver Lake. Mr. Havranek stated that would be more of an increase in rate. 45 <br /> 46 <br />3
