WHEREAS, <br />WHEREAS, <br />WHEREAS, <br />WHEREAS, <br />CITY OF ST. ANTHONY VILLAGE <br />RESOLUTION 19 -033 <br />A RESOLUTION APPROVING <br />THE ST. ANTHONY ADA TRANSITION PLAN <br />FOR PEDESTRIAN FACILITIES IN THE PUBLIC RIGHT OF WAY <br />the Federal government enacted the American with Disabilities Act of 1990 (ADA) to <br />protects qualified individuals with disabilities from discrimination on the basis of <br />disability in services, programs, and activities provided by State and local government <br />entities; and <br />Title II of the ADA requires that every public agency with more than 50 employees <br />develop and adopt an ADA Transition Plan which documents physical barriers to <br />accessibility, propose modifications to remove those barriers, and a schedule to complete <br />the modifications; and <br />city staff has completed a self - evaluation of all existing accessibility barriers on <br />pedestrian facilities in the public right -of -way; and <br />city staff has developed an ADA Transition Plan that outlines a phased approach for the <br />removal of barriers on pedestrian facilities in the public rights -of -way that are owned or <br />operated by the City of St. Anthony Village pursuant to the requirements of Title II of the <br />ADA; and <br />WHEREAS, the City has solicited public comments on the proposed ADA Transition Plan for <br />consideration by the City Council for adoption. <br />NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of St. Anthony Village hereby <br />approves the ADA Transition Plan for Pedestrian Facilities in the Public Right -of -Way, a copy of which <br />shall be filed with and maintained by the City Clerk. <br />Adopted this 9t" day of April, 2019. <br />erome O.
