Patio/Sidewalk Encroachment (Side Setback Variance) <br />Staff and Planning Commission recommends denial of the variance as requested. <br />The staff recommendation includes a requirement that the applicant make corrections <br />to the submitted plan, as well as the constructed improvements, to ensure that either <br />(a) any paved area greater than 5 feet in width meets the required 5 foot setback for <br />patios; or (b), any paved area is modified to be no more than 5 feet in width so as to <br />constitute a sidewalk rather than a patio. <br />2609 PAHL AVENUE <br />STAFF RECOMMENDATIONS <br />3. Impervious Surface Variance <br />Planning Commission recommends denial of the variance for the proposed <br />increase in impervious surface coverage to allow up to 3,400 square feet of <br />impervious surface, requiring removal of adequate paved surface to meet sidewalk <br />widths of no more than 5 feet, or patio setbacks of no less than 5 feet, and impervious <br />surface coverage of no more than 35%. <br />56
