<br />TIMELINE OF <br />THE PROCESS <br /> <br />SEPTEMBER 10, 2019 <br />The first reading by the <br />City Council <br /> <br />SEPTEMBER 24, 2019 <br />Second reading by the <br />City Council <br /> <br />OCTOBER 8, 2019 <br />Third and final reading <br />by the City Council to <br />adopt the ordinance <br /> <br />LATE OCTOBER, 2019 <br />Publishing of the revised <br />ordinance, which puts it <br />into effect as of the date <br />of publication. <br /> <br />ORDINANCE CHANGE <br />AMENDING THE TOBACCO ORDINANCE <br />TO RESTRICT SALES TO UNDER AGE 21 <br />SUMMARY <br />In recent years a number of cities and counties in Minnesota have <br />raised the minimum age to purchase tobacco to 21. The intention of this <br />approach is to increase the age gap between kids and those who can <br />legally buy tobacco, to help keep tobacco out of the school environment <br />and reduce early adoption of tobacco use among young people. <br />KEY ASPECTS OF THE CHANGES <br /> Increasing the minimum age to purchase tobacco from age 18 to 21 <br />(B) Legal age. No person shall sell any licensed product to any person <br />under the age of 21. <br />(1) Age verification. Licensees must verify by means of government- <br />issued photographic identification that the purchaser is at least 21 years <br />of age <br /> Enhancing language to ensure that vaping forms of tobacco are <br />clearly identified <br />Any product containing or delivering nicotine, lobelia, or any other <br />substance, whether natural or synthetic, intended for human consumption <br />through the inhalation of aerosol or vapor from the product. ELECTRONIC <br />DELIVERY DEVICE includes, but is not limited to, devices manufactured, <br />marketed, or sold as e-cigarettes, e-cigars, e-pipes, vape pens, mods, tank <br />systems, or under any other product name or descriptor. ELECTRONIC <br />DELIVERY DEVICE includes any component part of a product, whether or <br />not marketed or sold separately. ELECTRONIC DELIVERY DEVICE does <br />not include any product that has been approved or certified by the U.S. <br />Food and Drug Administration for sale as a tobacco-cessation product, as <br />a tobacco-dependence product, or for other medical purposes, and is <br />marketed and sold for such an approved purpose. <br /> Instituting a fine structure for retailers that fail compliance checks <br />Any licensee found to have violated this ordinance, or whose employee <br />violated this ordinance, will be charged an administrative fine of [ $200 ] for <br />a first violation; [ $500 ] for a second offense at the same licensed premises <br />within a 24-month period; and [ $750 ] for a third or subsequent offense at <br />the same location within a 24-month period. Upon the third violation, the <br />license will be suspended for a period of not less than [ 30 ] consecutive <br />days.
