He stated it has been a long process, but he was pleased the Council would be changing 2 <br />the minimum age to purchase to 21. He understood vaping was a serious issue and he supported 3 <br />the Council approving this Ordinance. 4 <br /> 5 <br />Motion by Councilmember Randle, seconded by Councilmember Gray, to approve first reading 6 <br />of Ordinance 2019-09; an Ordinance Amending Multiple Sections of Chapter 111 of the 7 <br />Tobacco Ordinance to Raise the Minimum Age to Purchase to 21. 8 <br /> 9 <br />Motion carried 4-0. 10 <br /> 11 <br />B. Ordinance 2019-08; an Ordinance Amending Sections 155.03, 155.21, and 155.22 of the 12 <br />Sign Ordinance (final reading and adoption). 13 <br /> 14 <br />City Manager Casey stated a sign request was received that raised the issue of Light Emitting 15 <br />Diodes (LED) technology and how it is regulated in the City’s sign ordinance. Staff and the 16 <br />Planning Commission discussed the issue briefly at May workshop and City Council workshop 17 <br />on July 16, 2019. Currently the ordinance defines any sign using LED technology as part of a 18 <br />Dynamic Display sign. 19 <br /> 20 <br />City Manager Casey reviewed the ordinance definition of Dynamic Display Signs, noting they 21 <br />require a Conditional Use Permit (CUP). The purpose of the limitations within Dynamic Display 22 <br />section of the sign ordinance and the CUP processing is to ensure these potentially distracting 23 <br />sign technologies are limited to minimize distraction. The standards that apply to Dynamic 24 <br />Displays are required, whether or not the sign uses LED technology, or whether the sign changes 25 <br />copy or images. 26 <br /> 27 <br />City Manager Casey explained when this ordinance is adopted, LED technology was still 28 <br />relatively new and its use was commonly applied to displays that appeared to imitate movement 29 <br />or video. More recently, LED lighting technology has become the dominant method of 30 <br />projecting most lighting, whether or not it used in stimulated video. As such, staff suggests that 31 <br />two changes be made to the Sign regulations that allow signage that is lit, but not simul 32 <br /> 33 <br />Motion by Councilmember Gray, seconded by Councilmember Stille, to approve final reading 34 <br />and adopt Ordinance 2019-08; an Ordinance Amending Sections 155.03, 155.21, and 155.22 of 35 <br />the Sign Ordinance. 36 <br /> 37 <br />Motion carried 4-0. 38 <br /> 39 <br />C.
