prominently and in plain view at all times at each location where licensed products are offered <br />for sale. The required signage, which will be provided to the licensee by the city, must be posted <br />in a manner that is clearly visible to anyone who is or is considering making a purchase. <br /> <br />(C) Self-service sales. No person shall allow the sale of licensed products by any self-service displays <br />where the customer may have access to those items without having to request the item from the <br />licensee or the licensee’s employee and where there is not a physical exchange of the licensed product <br />from the licensee or the licensee’s employee to the customer. All licensed products must be stored <br />behind the sales counter, in another area not freely accessible to customers, or in a case or other <br />storage unit not left open and accessible to the general public. Any retailer selling licensed products <br />at the time this ordinance is adopted must comply with this section within 90 days of the effective <br />date of this ordinance. As “loosies”, as defined in § 111.046; <br /> <br />(B)(D) Liquid packaging. No person shall sell or offer to sell any liquid, whether or not such liquid <br />contains nicotine, which is intended for human consumption and use in an electronic delivery device, <br />in packaging that is not child-resistant. Upon request by the city, a licensee must provide a copy of <br />the certificate of compliance or full laboratory testing report for the packaging used. <br /> <br />(C)(E) If the tobacco or tobacco products contain opium, morphine, jimsonweed, belladonna, <br />strychnos, cocaine, marijuana, or other delirious, hallucinogenic, toxic, or controlled substances except <br />nicotine and other substances found naturally in tobacco or added as part of an otherwise lawful <br />manufacturing process; and/or To any other person, in any other manner or form prohibited by federal or <br />state law or regulation, or by local ordinance. <br /> <br /> <br />§ 111.051 VENDING MACHINES. <br /> <br />It shall be unlawful for any person licensed under this code to allow the sale of licensed products <br />tobacco, tobacco products, or tobacco related devices, or electronic delivery devices by the means of a <br />vending machine unless persons under the age of 21 minors are at all times prohibited from entering the <br />licensed establishment. <br /> <br /> <br />§ 111.052 SELF-SERVICE SALES. <br /> <br />(A) It shall be unlawful for a licensee under this code to allow the sale of single packages of <br />cigarettes or smokeless tobacco if the customer may have access to the items without having to request <br />the item from the licensee of the licensee’s employees and if there is not a physical exchange of the single <br />packages of cigarettes or smokeless tobacco between the licensee or the licensee’s clerk and the customer. <br />All single packs of cigarettes or smokeless tobacco shall either be stored behind a counter, in a case or <br />other storage unit not left open and accessible to the general public, or otherwise are not freely accessible <br />to customers. Any retailer selling single packs of cigarettes or smokeless tobacco at the time of adoption <br />of this subchapter, shall have 60 days to comply with this section. <br /> <br />(B) At such time as the FDA regulations regarding self-service of tobacco products are adopted, <br />those provisions shall be adopted by reference and supercede the current self-service language of this <br />section. <br /> <br /> <br />§ 111.0523 RESPONSIBILITY. <br /> <br />95
