ORDINANCE NO. 2019-10 <br />SAINT ANTHONY VILLAGE, MINNESOTA <br /> <br />AN ORDINANCE AMENDING MULTIPLE SECTIONS OF CHAPTER 33 SEWER, WATER, <br />LICENSE AND PERMIT FEES, STORM WATER FACILITIES AND CHAPTER 52 WATER <br />READING AND BILLING <br /> <br />The City Council of the City of Saint Anthony Village ordains as follows: <br />Section One. Amendment to the City of Saint Anthony Village City Code to Amend Sections §33.015 <br />Sewer Charges to Owner; §33.016 Residential Premises, §33.019 Sewer Minimum Charge, §33.036 Water <br />Charges to Owner; §33.037 Water Minimum Charge, §33.038 Commencing & Discontinuing Service, §33.041 <br />Street Excavation, §33.061 Establishment of Fee Amounts, §33.090 Charges for Storm Water Facilities, and <br />§52.05 Water Reading and Billing of the City Code of the City of Saint Anthony Village is hereby amended as <br />follows. The additional language is represented by <br />single underlined text. <br />§ 33.015 CHARGES TO OWNER. <br /> <br />The owner of any property connected with the city sanitary sewer system must pay as basic rental charges <br />for the use of the system the charges set forth in this subchapter. <br />(1993 Code, § 605.01) <br /> <br />§ 33.016 RESIDENTIAL PREMISES. <br /> <br />(A) Charges based on water usage. All single-family, 2-family, and townhouse dwellings will be <br />charged quarterly based upon the number of gallons of water used during the months of January, <br />February, and March of each year, as determined from meter readings obtained by the water meters <br />electronically. <br /> <br />(B) Leak or malfunction. The quarterly charge will be based upon the actual meter readings for the first <br />quarter, notwithstanding any leak or malfunction in the plumbing system during the period. If the leak <br />or malfunction occurs during first quarter, the owner is responsible for paying the charges during that <br />period. When the leak is repaired by the city, the quarterly charge will be based upon meter history or <br />the subsequent quarter for which there is no leak or malfunction in the plumbing system. The quarterly <br />charge will be based upon the actual meter readings for the first quarter, notwithstanding any leak or <br />malfunction in the plumbing system during the period. If the leak or malfunction is repaired by the city, <br />the quarterly charge will be based upon the greater of 22,500 gallons or the water used during the most <br />recent first quarter for which there was no leak or malfunction in the plumbing system. <br /> <br />(C) Meter not used in first quarter. If a person becomes the occupant of residential premises during or <br />after the first quarter, and in any other case where a water meter is not in use during all of the first <br />quarter, the quarterly charge will be based on the previous fourth quarter or upon actual usage during <br />the second quarter. The charge will be prorated from the date of occupancy. If a person first becomes the <br />occupant of residential premises during or after the first quarter, and in any other case where a water <br />meter is not in use during all of the first quarter, the quarterly charge will be based upon actual usage <br />for the remaining quarters. The charge will be prorated from the date of occupancy. <br /> <br /> <br />(B)(D) Water service from other city. The occupants of any 1- or 2-family dwelling which is <br />connected to the water system of any other municipality must obtain and submit to the city water meter <br />readings of the type required by § 52.05. <br />(1993 Code, § 605.02)
