<br />Page 4 <br /> <br />The preceding requirements should clarify whether it applies to attached garages, detached <br />garages or both. <br /> <br />The current language appears to suggest than total garage area on the property may not <br />exceed 1,000 square feet, and no detached garage may be more than 750 square feet (or 80%). <br />But the language is not clear. <br /> <br />It is common practice to establish a cap on the total amount of amount of accessory storage <br />space on residential properties (both attached and detached accessory storage space). Further, <br />the conditional use permit process is commonly used to accommodate additional accessory <br />floor area (with a maximum floor area cap imposed). <br /> <br />Section 152.176.H of the Ordinance also states that one accessory building, in addition to any <br />detached garage, may be permitted, except that it shall not exceed 120 square feet in area if a <br />detached garage exists on the same lot. This provision raises question related to the use of <br />detached accessory structures. If a detached building which is not a garage exists on a site (but <br />is the same size), can the second building exceed 120 square feet is size? <br /> <br />An alternative approach would be to create specific allowances for each type of use and/or <br />structure, such as: <br /> <br />The following accessory buildings and uses shall be allowed on a single family <br />residential parcel, but in no case shall more than one such structure be allowed from <br />each category: <br /> <br />Attached Garages: XX (1,000?) Maximum Square Feet; <br />Detached Garages: XX (800?) Maximum Square Feet, or no more than XX% of <br />the footprint area of the principal structure, whichever is <br />less. (The City may regulate footprint size, or total usable <br />square footage, such as usable loft space). <br />Detached Garden/ <br />Utility Shed: XX (200?) Maximum Square Feet <br />Recreational Accessory <br /> Structure (e.g. Gazebo): XX (160?) Maximum Square Feet <br /> <br />The City may establish a maximum Total Garage Space requirement (combining attached and <br />detached buildings), or a maximum Total Accessory Use Space requirement. An example would <br />be: <br /> <br />In no case shall the maximum total detached accessory building space shall be no <br />more than 1,500 square feet. <br /> <br />If no maximum cap is established, the controlling requirements would be the individual building <br />sizes and the impervious surface standards for the zoning district. <br />
