<br />Page 7 <br /> <br /> <br /> <br />Shoreland Accessory Structures <br /> <br />An issue that the City and property owners have faced includes accessory structures adjacent to <br />the shoreline of Silver Lake. The City does not have separately required Shoreland zoning <br />requirements that are often mandated by the Minnesota DNR. As such, the setback <br />requirements for detached buildings in areas adjacent to the lake are technically required to <br />meet the general requirements of the zoning ordinance. <br /> <br />This issue comes into play in the R-1A District, which requires a 75 foot building setback for all <br />buildings adjacent to Silver Lake. Over time, there have been a variety of accessory uses placed <br />in the areas adjacent to the shoreland. <br /> <br />One of the requirements of the DNR’s model shoreland ordinance is a prohibiting on structures <br />in the “shore impact zone”, which is defined in the model ordinance as being the land along the <br />lake up to one-half of the required setback. In this regard, the model shoreland ordinance <br />would allow detached accessory buildings and uses at the 37.5 foot setback mark in the R-1A <br />District. <br /> <br />The model shoreland regulations also accommodate the potential for cities to allow an <br />encroachment for a “water-oriented accessory structure”. These structures are often used for <br />storage of water equipment commonly by shoreland owners. The city should consider whether <br />any accommodation of a reduced setback along the shoreline would be acceptable. <br /> <br />OTHER POSSIBLE CHANGES/ADDITIONS <br /> <br />• Create a table which clarifies accessory structure requirements (number of buildings, <br />floor areas, setbacks etc.). <br /> <br />• Consider the addition of illustrations <br /> <br />With the comments from the Commission, staff would expect to develop draft ordinance <br />language and other support text (such as the table and/or illustrations) for consideration at a <br />public hearing. The Commission may choose to call for that hearing, or continue discussion to <br />an additional workshop date. <br /> <br />No specific action is expected at the Workshop, other than direction for further follow-up by <br />staff. <br />
