Miscellaneous Requirements and Commitments <br />1. Other Permits <br />The Developer shall be responsible for securing all necessary approvals and permits <br />from all appropriate federal, state, regional and local jurisdictions prior to the <br />commencement of construction of the Project. <br />2. Work <br />All labor and work shall be done and performed in a good and workmanlike manner <br />and in strict conformance with the approved plans and specifications on file with <br />the City. No material deviations from the approved plans and specifications will be <br />permitted unless approved in writing by the City engineer, such approval not to be <br />unreasonably withheld, conditioned or delayed. <br />3. Testing <br />The Developer shall provide all staking, surveying and material testing for the <br />above described improvements to ensure that the completed improvements <br />conform to the approved plans and specifications. The City will provide for <br />overview inspection and shall be notified of all tests to be performed and the <br />Developer and the City will be provided with copies of all test results. Any <br />additional testing and inspection that is required by the City shall be provided by <br />the Developer at the Developer's expense. <br />4. Grading <br />a. Finished grading will be performed for all building sites, common green and <br />open spaces, all private driveways and storm water management facilities in <br />accordance with the approved grading, drainage and site plans. <br />b. Grading will be performed pursuant to the City's Land Disturbance Ordinance <br />and the land disturbance permit issued by the City. <br />5. Pathways and Sidewalks <br />The Developer shall be responsible for installing the pathways and sidewalks within <br />the Project. Subsequent to installation, the pathways and sidewalks within the <br />Project shall be maintained by the Developer or Lot Owner. Such maintenance shall <br />10 <br />623964v4 <br />
