PLANNED UNIT DEVELOPMENT AGREEMENT <br />THIS PLANNED UNIT DEVELOPMENT AGREEMENT (this "Development <br />Agreement"), dated [ }, 2019, by and between the City of Saint Anthony Village, <br />Minnesota, a statutory city under the laws of the State of Minnesota (the "City"), and Doran <br />SLV, LLC, a Minnesota limited liability company (the "Developer") (collectively the <br />"Parties"). <br />RECITALS <br />WHEREAS, the Developer has made application to the City for approval of the <br />construction and use of improvements on certain land within corporate limits of the City <br />legally described on Exhibit A, attached hereto and made a part hereof (the "Property); <br />and <br />WHEREAS, the City Council granted a Planned Unit Development ("PUD"), <br />Preliminary Plat, and Final Site and Building Plan approval to the Developer and use of <br />improvements for a two-phase, multi -family development as more particularly described <br />in the foregoing (the "Project"), on the condition that the Parties enter into this <br />Development Agreement stipulating, among other things, the conditions of approval (the <br />"Project PUD Approvals") for the Work, including public improvements as well as the <br />development of on -site improvements, described in this Development Agreement and in <br />the Environment Assessment Worksheet prepared by WSB & Associates, Inc., Project No. <br />R-013966-000 (the "EAW") on file in the offices of the City, provided to the Developer, <br />and incorporated herein by reference, all in accordance with the terms and conditions <br />hereinafter set forth. <br />623964v4 <br />
