<br /> <br /> <br />REQUEST FOR COUNCIL CONSIDERATION <br /> <br /> <br />Meeting Date: February 11, 2020 <br /> <br /> <br />Resolution – Amending the Silver Lake Village Street Maintenance Agreement <br /> <br /> <br />OVERVIEW: <br /> <br />In front of you, this evening is an amendment to the Silver Lake Village Street Maintenance <br />Agreement. <br /> <br />As part of the original development of the retail portions of Silver Lake Village, the retail developer <br />agreed to maintain the non-traffic portions of the 39th Avenue right-of-way. This obligation remains <br />in place as the obligation of the current owners (IRC Silver Lake Village, L.L.C.). If the retail <br />property owners ever fail to do the required maintenance work, the City has the right to perform the <br />work and assess the costs against the retail parcels of land through a Street Maintenance Agreement. <br />To this point, the maintenance work has been performed and the City has not had to step-in or assess <br />costs <br /> <br />As part of the current Doran housing development, Doran has asked that the former Walmart parcel be <br />released from the obligation to be assessed. IRC Silver Lake Village, as the current owner of other <br />retail parcels, has agreed to assume the responsibility for any assessments that may occur in the future <br />through an Amendment to Street Maintenance Agreement. <br /> <br />The City is being asked to agree to this Amendment. This Amendment reflects that the retail <br />properties (and not residential) in Silver Lake Village should continue to have the obligation to <br />maintain portions of 39th Avenue adjacent to the retail areas. By executing the Amendment, the City <br />continues to have the right to assess the remaining retail properties if the need ever arises. <br />21
