Page 6 of 35 <br /> <br /> <br /> <br /> <br />Effect of St. Anthony Ordinance <br /> <br />The St. Anthony ordinance referenced by Detective Ruston is Section 91.36 of the City Code: <br /> <br /> <br /> <br />The practical and foreseeable effect of this ordinance, if valid and applicable to Hammerheart, is <br />tantamount to an order that Hammerheart be destroyed/killed. No animal rescues in Minnesota will <br />accept a dog for surrender whom has been declared to be a dangerous dog. It is not feasible for us to <br />move, nor is it our desire. We have explored some options to re-home Hammerheart with someone we <br />know, to no avail. We do not want to post a random ad for someone to adopt Hammerheart as a person <br />could seek a pit bull whom has been labeled dangerous and intend to use them for an improper purpose, <br />which may pose a poor quality of life for Hammerheart and a danger to the public. <br /> <br />The effect of the ordinance is for Hammerheart to be put down despite the fact that no one – not Mr. <br />Pearson, Mr. Hayden, or either police officer whom responded to the incidents – has indicated to us that <br />they believe kill order of Hammerheart is either necessary or appropriate. <br /> <br />Training Evaluation & Training Plan after Incident on May 28, 2020 <br /> <br />On June 18, 2020, we had Ms. Willeke with Bark Busters come to our home to evaluate Hammeheart and <br />update the dogs’ training plan. As part of the evaluation, Ms. Willeke observed Hammerheart near, but <br />not on the sidewalk, where there were numerous bikers, runners and other dogs. <br /> <br />Ms Willeke notes that Hammerheart has become much less reactive since the first training visit in May <br />2018 and that she believes he can get even better. Ms. Willeke’s training plan focuses on reconditioning <br />the dogs’ emotional responses to movement from bikes and runners through a variety of training methods. <br />The training method that Ms. Willeke emphasized to focus on involve re-directing Hammerheart at first <br />distraction prior to their being a reaction. The invoice and notes from the training session are enclosed <br />with this appeal. See Exhibit 5. <br /> <br />In the event that Hammerheart remains a part of our family, we will be training diligently to decrease his <br />leash reactiveness under the guidance of Ms. Willeke. We purchased in May 2018 a lifetime training <br />membership that includes an unlimited number of in-home training visits for Hammerheart. <br /> <br /> <br /> <br />22
