1 <br />Mayor Stille commended on the studies ordered by the City. The City is an independent body, 2 <br />and there was talk about the applicant ordering the studies which would have most likely come 3 <br />back in favor of the applicant. 4 <br /> 5 <br />City Attorney Lindgren read five paragraphs to be included in the motion. 6 <br /> 7 <br />Motion by Councilmember Webster, seconded by Councilmember Jenson, to deny Resolution 8 <br />21-024; a Resolution to approve a Conditional Use Permit for a car wash facility with vacuum 9 <br />stations at 2701 Kenzie Terrance in the C, Commercial District with the following findings of 10 <br />fact in support of the denial: 11 <br />1. The purpose of the Conditional Use Permit requirement for the car wash use in the 12 <br />Business zoning district is to consider whether or not the use can be compatible with 13 <br />the neighboring land uses. 14 <br />2. The proposed use will create noise, fumes, lights, and other potential negative 15 <br />impacts on adjoining residential properties. 16 <br />3. While some mitigation is possible to reduce those impacts to levels that may comply 17 <br />with the minimum requirements of state standards, the impacts are nonetheless likely 18 <br />to negatively affect the quality of life of the existing adjoining and nearby residents, 19 <br />given the height, exposure, and nearness of those existing uses. 20 <br />4. The zoning ordinance requires that to approve a Conditional Use Permit, the City 21 <br />Council must determine that: “The use will not be detrimental to the health, safety, or 22 <br />general welfare of persons residing or working in the vicinity or to the values of 23 <br />property in the vicinity.” 24 <br />5. Based on the written record and the additional information provided at the March 9, 25 <br />2021, City Council meeting, the City Council finds that (a) the required determination 26 <br />cannot be made (b) that the use would be detrimental to health, safety, general 27 <br />welfare, or property values in the vicinity of the proposed use; and (c) that 28 <br />insufficient mitigating conditions are available to overcome this detrimental 29 <br />incompatibility. 30 <br /> 31 <br />Motion carried 4-1 (Randle). 32 <br /> 33 <br />VII.
