The City is an independent body, <br />and there was talk about the applicant ordering the studies which would have most likely come <br />back in favor of the applicant. <br />City Attorney Lindgren read five paragraphs to be included in the motion. <br />Motion by Councilmember Webster, seconded by Councilmember Jenson, to deny Resolution <br />21-024; a Resolution to approve a Conditional Use Permit for a car wash facility with vacuum <br />stations at 2701 Kenzie Terrance in the C, Commercial District with the following findings of <br />fact in support of the denial: <br />1. The purpose of the Conditional Use Permit requirement for the car wash use in the <br />Business zoning district is to consider whether or not the use can be compatible with <br />the neighboring land uses. <br />2. The proposed use will create noise, fumes, lights, and other potential negative <br />impacts on adjoining residential properties. <br />3. While some mitigation is possible to reduce those impacts to levels that may comply <br />with the minimum requirements of state standards, the impacts are nonetheless likely <br />to negatively affect the quality of life of the existing adjoining and nearby residents, <br />given the height, exposure, and nearness of those existing uses. <br />4. The zoning ordinance requires that to approve a Conditional Use Permit, the City <br />Council must determine that: "The use will not be detrimental to the health, safety, or <br />general welfare of persons residing or working in the vicinity or to the values of <br />property in the vicinity." <br />5. Based on the written record and the additional information provided at the March 9, <br />2021, City Council meeting, the City Council finds that (a) the required determination <br />cannot be made (b) that the use would be detrimental to health, safety, general <br />welfare, or property values in the vicinity of the proposed use; and (c) that <br />insufficient mitigating conditions are available to overcome this detrimental <br />incompatibility. <br />Motion carried 4-1 (Randle). <br />VII. REPORTS FROM CITY MANAGER AND COUNCIL <br />City Manager Yunker had no report. <br />Councilmember Webster had no report. <br />Councilmember Randle had no report. <br />Councilmember Jenson stated on March 5, 2021, he had two meetings with Ramsey County <br />Local League of Governments. <br />Councilmember Walker had no report. <br />
