City Council Regular Meeting Minutes <br />May 25, 2021 <br />Page 2 <br /> <br />A. Resolution 21-051; a Resolution Approving a Request for a Lot Combination for 3632 1 <br />Roosevelt Street NE, PID 06-029-23-22-0089 and 06-029-23-22-0090. 2 <br /> 3 <br />City Planner Grittman reviewed the applicant is requesting a combination of two existing 4 <br />parcels, zoned R-1, Single Family Residential. The current use is a single-family home. The 5 <br />property formerly contained a detached garage in the rear yard that was destroyed by fire. In 6 <br />reviewing the proposed rebuild, it was discovered that the property consists of two separate 7 <br />parcels of record, with the boundary line running through the original (and proposed rebuilt) 8 <br />garage location. Due to building code issues, the garage would not be able to meet building code 9 <br />requirements (or zoning setbacks) due to the lot line. To remedy the property condition, and 10 <br />accommodate a rebuild of the garage, the lots must be combined into a single parcel. Under the 11 <br />current certificate of title, the applicant has indicated that Hennepin County treats the property as 12 <br />a single parcel; however, the parcels are shown separately on the County’s website. This 13 <br />combination process is necessary to correct the problem and qualify the lot for building permit. 14 <br /> 15 <br />Mr. Grittman provided an analysis of this request and planning staff believes that the tests for 16 <br />“reasonable use” and the exceptions to the full platting requirement are present to qualify the 17 <br />request for a minor subdivision. 18 <br /> 19 <br />Staff recommends approval of the proposed subdivision, based on the following findings: 20 <br />1. The proposed parcel exceeds both zoning requirements and the minimum thresholds for 21 <br />consideration of subdivision without platting. 22 <br />2. The resulting combined parcel created will accommodate the proposed land use allowed on 23 <br />the property under existing and/or future plans. 24 <br />3. Platting is not necessary for these two parcels, and the process for platting would create an 25 <br />unnecessary procedural requirement for a minor lot combination as proposed. 26 <br />4. The survey providing the revised legal description verifies improvements on the property for 27 <br />the purpose of re-establishing prior structures. 28 <br />5. The minor subdivision does not interfere with the purposes of the Subdivision Ordinance, the 29 <br />Zoning Ordinance, or other applicable regulations and plans. 30 <br /> 31 <br />Mr. Grittman stated one condition goes along with an approval motion. 32 <br />1. County acceptance of the descriptions for recording, as submitted. 33 <br /> 34 <br />Motion by Councilmember Jenson, seconded by Councilmember Walker, to adopt Resolution 35 <br />21-051; a Resolution Approving a Request for a Lot Combination for 3632 Roosevelt Street NE, 36 <br />PID 06-029-23-22-0089 and 06-029-23-22-0090, based on the findings and subject to the 37 <br />condition of County acceptance of the descriptions for recording, as submitted. 38 <br /> 39 <br />Motion carried 4-0. 40 <br /> 41 <br />B.
