<br /> ORDINANCE NO. 2019-09 <br />SAINT ANTHONY VILLAGE, MINNESOTA <br /> <br />AN ORDINANCE AMENDING MULTIPLE SECTIONS OF CHAPTER 111 OF THE TOBACCO <br />ORDINANCE <br /> <br />The City Council of the City of Saint Anthony Village ordains as follows: <br />Section One. Amendment to the City of Saint Anthony Village City Code to Amend Chapter 111 Tobacco <br />of the City Code of the City of Saint Anthony Village is hereby amended as follows. The deleted language is <br />represented by strikethrough text. The additional language is represented by single underlined text. <br /> <br />TOBACCO <br /> <br /> <br />§ 111.045 PURPOSE AND INTENT. <br /> <br />This ordinance is intended to regulate the sale of commercial tobacco, tobacco-related devices, <br />electronic delivery devices, and nicotine or lobelia delivery products for the purpose of enforcing and <br />furthering existing laws, to protect youth and young adults against the serious health effects associated <br />with use and initiation, and to further the official public policy of the state to prevent young people from <br />starting to smoke, and because marketing analysis, public health research, and commercial tobacco <br />industry documents reveal that tobacco companies have used menthol, mint, fruit, candy, and alcohol <br />flavors as a way to target youth and young adults and that the presence of such flavors can make it more <br />difficult to quit. <br /> <br />The city further recognizes the public health hazards of exposure of individuals to secondhand <br />smoke. This subchapter is intended to regulate the sale, possession, and use of tobacco, tobacco products, <br />tobacco related devices, and electronic delivery devices for the purpose of enforcing and furthering <br />existing laws, to protect minors against the serious effects associated with the illegal use of tobacco, <br />tobacco products, tobacco related devices, and electronic delivery devices, to protect individuals from <br />the hazards of secondhand smoke, and to further the official public policy of the State of Minnesota as <br />stated in M.S. § 144.391 and M.S. § 144.412, as they may be amended from time to time. <br /> <br />§ 111.046 DEFINITIONS. <br /> <br />For the purpose of this subchapter, the following definitions shall apply unless the context clearly <br />indicates or requires a different meaning. <br /> <br />CHILD-RESISTANT PACKAGING. Packaging that meets the definition set forth in Code of <br />Federal Regulations, title 16, section 1700.15(b), as in effect on January 1, 2015, and was tested in <br />accordance with the method described in Code of Federal Regulations, title 16, section 1700.20, as in <br />effect on January 1, 2015. <br /> <br />CIGAR. Any roll of tobacco that is wrapped in tobacco leaf or in any other substance containing <br />tobacco, with or without a tip or mouthpiece, which is not a cigarette as defined in Minn. Stat. § <br />297F.01, subd. 3, as may be amended from time to time. <br /> <br />COMPLIANCE CHECKS.
