The specific standards that apply to R-3 <br />1A (shoreland) uses are also listed here – most of these regulations are missing or unclear 4 <br />from current code. 5 <br /> 6 <br />The applicable Code Sections are Title XV Land Usage, Chapter 152 Zoning Code, Section 7 <br />§152.008 provides definitions related to Zoning. Title XV Land Usage, Chapter 152 Zoning 8 <br />Code, Section §152.176 Dynamic Displays regulates the construction and use of electronic 9 <br />dynamic display signs by Conditional Use Permit and sets the various performance standards 10 <br />applicable to such signs. 11 <br /> 12 <br />Staff recommends approval of the proposed amendment to the Zoning Ordinance, due to the 13 <br />various conflicts and/or missing components of current standards. It is the intention of staff 14 <br />that by consolidating the regulations as proposed, they will be clearer and more easily applied 15 <br />by staff and property owners alike. 16 <br /> 17 <br />There were no public comments. 18 <br /> 19 <br />Chairperson Westrick closed the public hearing at 7:17 p.m. 20 <br /> 21 <br />Commissioner Erickson thanked staff for providing the changes to the Zoning Code. He asked 22 <br />if the changes were based solely on the comments from the Planning Commission Work 23 <br />session or are they based on the Zoning Code of another City, and if so which City. Mr. 24 <br />Grittman stated the majority of the comments were from the Work Session. The City’s Code 25 <br />Enforcement Staff also reviewed and gave input. Some of the definition changes came from a 26 <br />number of different communities including North Oaks, Eden Prairie and Monticello. 27 <br /> 28 <br />Commissioner Socha stated the organization was much clearer. The square footage for the 29 <br />detached garage or accessory major building, is limited to 750 sf or 80% of ground floor. The 30 <br />previous Code stated 1000 sf or 80% whichever is less. She does not believe it makes sense 31 <br />that an attached garage can be just as large as the principal building but not a detached garage. 32 <br />She believes for many of the smaller homes it would be better to allow for a larger detached 33 <br />building for storage. She would like to propose this be modified. Mr. Grittman stated the 34 <br />previous document stated both 750 and 1000sf. He would not have an issue modifying this to 35 <br />1000sf or 80% whichever is less. 36 <br /> 37 <br />Commissioner Morita asked if a standard two car garage was 750sf. Mr. Grittman stated a 38 <br />standard two car garage would be 500sf. 750sf would accommodate three cars. He does not 39 <br />believe 750sf is restrictive and that would seem adequate. 40 <br /> 41 <br />Commissioner Erickson stated most of the St. Anthony sites are more on the smaller side. 42 <br />Most likely 1000sf would not be allowed with the setbacks. He would not be opposed to 43 <br />either number. 44 <br /> 45
