<br /> <br />MEMORANDUM <br /> <br /> <br />To: St. Anthony Village Planning Commission <br />From: Stephen Grittman, City Planner <br />Date: Planning Commission Meeting – August 17, 2021 <br />NAC Project No. 323.01 – 20.05 <br />Request: Request for Variance to Front Yard Fence Setback Requirement <br /> <br />Property Address: 3501 Maplewood Drive <br /> <br />Property PID: 06-029-23-11-0093 <br /> <br /> <br />STAFF RECOMMENDATION <br />The applicant proposes to construct a fence to enclose a proposed swimming pool on the west <br />side of their property at the above address. Fences are allowed to be up to 6 feet in height in <br />side and rear yards (behind the front building setback line), and 4 feet in height in front yards. <br />The applicant is proposing to extend the fence toward the Maplewood Drive property line, into <br />the setback area that requires a height of no more than 4 feet, but build it at the 6 foot height. <br />That encroachment of a 6 foot high fence requires approval of a variance. <br />In reviewing the proposed improvements against the ordinance requirements for lot <br />development, and the considerations for variance, staff recommends denial of the fence height <br />encroachment as proposed. <br />Staff has reviewed for height, use, other setbacks, and impervious surface. At issue is the <br />required impervious surface and existence of a back-yard shed. The current impervious surface <br />appears to be approximately 27%, based on aerial photos of the site, not including the existing <br />shed. . The maximum impervious surface for lots of 9,000 square feet or more (the subject lot <br />is 10,560 square feet) is up to 35% coverage. <br />However, the addition of the pool and pool deck, which are not shown in the application, would <br />be limited to a total area of approximately 840 square feet, including the pool decking. <br />Depending on the dimensions, the pool and decking are likely to be able to fit within the <br />required setbacks, and as such, staff does not believe that the requirements for variance <br />approval have been met. <br />
