City Council Regular Meeting Minutes <br />January 25, 2022 <br />Page 2 <br />Motion by Councilmember Walker, seconded by Councilmember Randle, to approve the <br />Consent Agenda items. <br />Motion carried 5-0. <br />IV. PUBLIC HEARING - NONE. <br />V. REPORTS FROM COMMISSION AND STAFF. <br />10 A. Resolution 22-016 — &proving a Request for a Conditional Use Permit for an Electronic <br />11 Dynamic Display at 3303 33`d Avenue NE in the "ROS, Recreation Oven Space Zoning <br />12 District. <br />13 <br />14 Planning Commissioner Morita reviewed the applicant (St. Anthony — New Brighton <br />15 Independent School District 282) is proposing to upgrade an existing ground sign for message <br />16 displays located at 3303 33'a Avenue NE. The ground sign is located along the south side of the <br />17 building, adjacent to 33 d Ave NE. Because a portion of the sign includes an electronic digital <br />18 display, the sign requires a Conditional Use Permit pursuant to Section 155.29 of the City's Sign <br />19 Ordinance. <br />20 <br />21 The Planning Commission reviewed the request at a public hearing on December 21, 2021. <br />22 Public input related to concerns over the School District's use of funding for the sign. A <br />23 representative of the District reported to the Commission that the existing sign had been in place <br />24 for a period longer than its projected useful life and was no longer functional. The representative <br />25 further indicated that the requirements for compliance imposed by the Code, and mentioned in <br />26 the staff report, would be met, including the required black background. After discussion, the <br />27 Commission approved a motion to recommend approval of the Conditional Use Permit to the <br />28 City Council, based on discussed findings that included consistency with the ordinance <br />29 requirements for such signs, and the ability to meet the operational recommendations as stated in <br />30 the Staff report. <br />31 <br />32 Based on a review of the proposed sign and the applicable regulations, Planning Staff and the <br />33 Planning Commission recommend approval of the CUP request, with conditions related to <br />34 compliance with code requirements applicable to dynamic display signs. <br />35 <br />36 A PowerPoint presentation was given showing drawings and photographs of the proposed sign <br />37 and location. The conditions of the recommendation are the applicant must submit plans showing <br />38 a height of no more than 8 feet and compliance with the operational standards of the code in <br />39 Section 155.29, notably the requirements for a static, monochrome message of at least 8 seconds <br />40 duration, a black background, and other related requirements. <br />41 <br />42 Councilmember Walker asked about the code regarding the use of electronic signs and Mayor <br />43 Stille stated the code was revised as to not distract drivers with rapid moving lights. Mayor Stille <br />44 added the City Council decides what the conditions of the CUP are to be. The School District <br />45 will be spending the money for the sign. <br />46 <br />
