<br />G:\.Clients All\St. Anthony\City Engineer\MCES II Surcharge\MOU\LTR-hmcc-060822.docx 178 E 9TH STREET | SUITE 200 | SAINT PAUL, MN | 55101 | 651.286.8450 | WSBENG.COM June 8, 2022 <br /> <br /> <br /> <br />Honorable Mayor, City Council and Staff <br />C/O Charlie Yunker, City Manager <br />City of St. Anthony Village <br />3301 Silver Lake Road NE <br />St. Anthony, MN 55418 <br /> <br /> <br />Re: Resolution Approving the Memorandum of Understanding between the <br />City of St. Anthony Village and the Metropolitan Council of Environmental Services <br /> <br />Dear Honorable Mayor, City Council and Staff: <br /> <br />Attached for your consideration is a resolution approving the Memorandum of Understanding <br />(MOU) related to the Ongoing Inflow and Infiltration (I/I) Program between the City of St. Anthony <br />Village and the Metropolitan Council of Environmental Services (MCES). <br /> <br />The City of St. Anthony Village is currently identified by the MCES as a contributor of excess I/I <br />and as such is included in the MCES I/I Surcharge Program. <br /> <br />Since being identified as a contributor of excessive I/I, the City has taken an aggressive approach <br />to the mitigate I/I, some of which includes: <br /> <br />• Adopted a City Ordinance that prohibits and requires disconnection of foundation <br />(passive) drains, sump pumps, and rain leaders <br />• City-wide passive drain and sump pump inspection completed in 2007 <br />• Implementation of a “point of sale” inspection program of sump pump and passive <br />drainage systems. <br />• Annual street reconstruction programs include the complete replacement of sanitary <br />sewer system located within road right-of-way <br />• Private sanitary sewer service video inspection of all properties within Street & Utility <br />Improvement areas and assistance with coordinating repair and/or replacement <br />• Pre- and post-reconstruction sanitary sewer flow monitoring <br /> <br />The City has recently completed the most recent I/I mitigation work plan mandated by the MCES <br />from the surcharge event that occurred in 2014 and continues complete projects annually to <br />reduce and eventually eliminate I/I. As such, City staff has worked closely with the MCES and has <br />requested that MCES consider removing the City from the I/I Surcharge Program. The MCES has <br />agreed to remove the City from the I/I Surcharge Program under the condition the City enter into <br />a Memorandum of Understanding (MOU) with the MCES to undertake a Long-Term I/I Mitigation <br />Program, which includes: <br /> <br />• The City will adopt and implement ordinances which will require a “point of sale” I/I <br />inspection of all private sanitary sewer services. As existing homes and commercial <br />properties within the City are sold, the City will administer an ongoing program requiring a <br />video condition inspection of the sanitary sewer service. Properties found out of <br />compliance will be required to be brought into compliance within the timeframe specified <br />in the MOU.
