No resident or public comments were received. <br />6 <br />7 Motion by Councilmember Webster, seconded by Councilmember Jenson, to Adopt Third and <br />8 Final Reading of Ordinance 2022-03 – Amending the St. Anthony City Code by Amending <br />9 Sections Related to Swimming Pools, Refuse Handling, Signs, Natural Landscapes, Parking, <br />10 Accessory Uses and Administrative Procedures. <br />11 <br />12 Motion carried 5-0. <br />13 <br />C.14 Resolution 22-042 Approving Summary Publication for Ordinance 2022-03. <br />15 <br />16 Mayor Stille reviewed this resolution is for approval of Summary Publication for Ordinance <br />17 2022 – 03. <br />18 <br />19 Motion by Councilmember Jenson, seconded by Councilmember Walker, to approve Resolution <br />20 22-042 Approving Summary Publication for Ordinance 2022-03. <br />21 <br />22 Motion carried 5-0. <br />23 <br />D.24 Resolution 22-049 – Approving Stormwater Facilities Maintenance Agreement and <br />25 Restrictive Covenant Between Lowry Retail LLC, and the City of St. Anthony Village. <br />26 <br />27 City Manager Yunker reviewed the Stormwater Facilities Maintenance Agreement and <br />28 Restrictive Covenant related to the Bremer Bank improvement project. Such an agreement is <br />29 required as the improvement as proposed will consist of constructing an underground stormwater <br />30 collection and treatment facility on the Property. <br />31 <br />32 Per the agreement, the applicant shall: <br />1.33 Agree to construct and maintain an underground stormwater management facility on his/her <br />34 property as shown on the approved drawing in exhibit B. <br />2.35 Maintain and preserve the underground stormwater management facility until such time as <br />36 the City, its successors or assignees, agree that the underground stormwater management <br />37 facility should be altered in some manner or eliminated. <br />3.38 Not to dismantle, revise, alter or remove part of the underground stormwater management <br />39 facility except as necessary for maintenance, repair or replacement. <br />4.40 Be responsible for inspecting and maintaining the underground stormwater management <br />41 facility, on an annual basis. The property owner will provide a letter to the City Engineer by <br />42 September 1st of each year, stating that inspection and maintenance have been completed. <br />5.43 Assume all responsibility for the cost of any maintenance and for repairs to the drainage <br />44 underground stormwater management facility. Such responsibility shall include <br />45 reimbursement to the City within 30 days after the City mails an invoice to the Owner for
