<br />K:\020198-000\Admin\Docs\LTR-hmcc-060822.docx 178 E 9TH STREET | SUITE 200 | SAINT PAUL, MN | 55101 | 651.286.8450 | WSBENG.COM June 8, 2022 <br /> <br /> <br /> <br />Honorable Mayor, City Council and Staff <br />C/O Charlie Yunker, City Manager <br />City of St. Anthony Village <br />3301 Silver Lake Road NE <br />St. Anthony, MN 55418 <br /> <br /> <br />Re: 2534 Kenzie Terrace Phase II Environmental Site Assessment <br />City of St. Anthony Village, MN <br />WSB Project #: 020198-000 <br /> <br />Dear Honorable Mayor, City Council and Staff: <br /> <br />WSB was retained by the City of St. Anthony Village to conduct a Phase II <br />Environmental Site Assessment (ESA) at the vacant property located at 2534 Kenzie <br />Terrace in St. Anthony, Minnesota. <br /> <br />WSBs determined that western portion of the 2534 Kenzie Terrace property contains low <br />levels of petroleum and nonpetroleum compounds in soil, groundwater, and soil vapor. <br />However, based on the proposed redevelopment of the property as a City welcome sign, <br />it is not likely that contaminated soil or groundwater will be encountered during this <br />proposed construction. <br /> <br />The City is not required to clean up the contamination prior to or after purchase. Rather, <br />the City is only required to manage impacted materials generated/encountered during <br />future construction activities (e.g., disposing excavated contaminated soil at a permitted <br />landfill). Soil and groundwater contamination was identified at a depth of 10 feet or more <br />below grade during the environmental investigation. <br /> <br />Voluntary parties can seek liability assurance letter(s) from the MPCA stating that they <br />will not be held responsible for contamination identified at a property and/or confirming <br />that the identified contamination does not pose a risk to human health or the <br />environment, based on the current or proposed property use. As a result, it is <br />recommended that the City enroll the property into the MPCA’s Brownfields Program for <br />technical assistance and to request eligible lability assurance letters. One such letter is <br />a No Association Determination (NAD), which is a determination from the MPCA that the <br />specific actions proposed by the voluntary party will not associate them with the <br />identified contamination. <br /> <br />It is also recommended that the City prepare a Construction Contingency Plan (CCP) <br />prior to construction. The CCP will outline the required methods and procedures to be <br />followed in the event that contamination is encountered during redevelopment. <br />
