Ordinance 2022-07 — An Ordinance Amending the St. Anthonv Citv Code, by Amending: 2 Sections 91.06, 91.56, 91.57 Relating to Keeping and Feeding of Animals; Section 94.15 3 and 96.02 Relating to the Use of the Public Right of Way; Section 96.03 Relating to 4 Private Bus and Transit Benches; Section 150.070—150.073, Relating to Allowable 5 Residential Fence Height and Measurement. 6 7 City Manager Yunker reviewed a committee of staff has been reviewing the City Code to 8 address various aspects of the language, looking for updating needs, and incorporating staff 9 experience with permitting issues, property owner questions, and code enforcement experience. 10 A second round of updates to the table -form list of proposed City Code and Zoning Code 11 amended language comes before the City Council for consideration. A public hearing was held at 12 the August Planning Commission meeting to formally consider the proposed language and 13 provide any final edits or recommendations. 14 15 Staff and the Planning Commission recommend the City Council adopts the proposed 16 amendments to the City Code. 17 18 19 Motion by Councilmember Randle, seconded by Councilmember Jenson, to approve Second 20 Reading of Ordinance 2022-07 — An Ordinance Amending the St. Anthony City Code, by 21 Amending: Sections 91.06, 91.56, 91.57 Relating to Keeping and Feeding of Animals; Section 22 94.15 and 96.02 Relating to the Use of the Public Right of Way; Section 96.03 Relating to 23 Private Bus and Transit Benches; Section 150.070—150.073, Relating to Allowable Residential 24 Fence Height and Measurement. 25 26 Motion carried 5-0. 27 28 C. Resolution 22-065 — Authorizing the Mutual Aid Agreement Between the City of St. 29 Anthony Village Public Works and Other Agencies Within the State of Minnesota. 30 31 Public Works Director Jeremy Gumke reviewed the purpose of this agreement is to provide a 32 process for local units of government to share public works personnel and equipment with 33 participating agencies. There is no membership or fixed cost to participate in this public works 34 mutual aid pact. 35 36 This agreement should not be interpreted as being limited to only use during catastrophic 37 situations, rather it may be leveraged for routine circumstances such as training efforts and 38 maintenance operations for example. The decision when to request assistance or provide 39 assistance is left entirely to the discretion of the requesting and/or sending party. The sending 40 party has discretion whether to provide personnel or equipment and can recall such assistance at 41 any time. 42 43 If resources are requested it should be expected that those costs would be invoiced, however the 44 agreement says that "charges may be levied", so it is the decision of the sending party whether or 45 not to invoice the receiving party. The agreement also speaks to responsibility and liability. Each 46 party shall be responsible for its own personnel or damaged equipment. Responding personnel
