MEMORANDUM <br />To:Saint Anthony Village City Council <br />From:Charlie Yunker, City Manager <br />Date:July 26, 2022 City Council Meeting <br />Request:Consider resolution to adopt and Interim Ordinance establishing a moratorium on the sale of <br />certain edible cannabinoid products <br />OVERVIEW <br />On July 1, 2022, a new law took effect that allows people 21 and over to buy and consume food and beverages <br />with no more than 5 milligrams of hemp-derived THC per serving and no more than 50 milligrams per package. <br />The new law was passed by the Legislature as part of Chapter 98. Article 13 makes several changes to Minnesota <br />Statutes, section 151.72 regarding the sale of certain cannabinoid (CBD) products. <br />The City’s Code regulates the sale of medical cannabis and dispensaries, however, it does not regulate the sale <br />of edible cannabinoid products. And, the new law does not require edible cannabinoid products to be sold from <br />a dispensary. The City has the authority to be more restrictive than state law, but not less restrictive. <br />The City Council discussed the new law at its Work Session on July 12, 2022, and the consensus was to adopt an <br />interim ordinance that would place a moratorium for up to one year on the sale of those products specified in <br />Minnesota Statutes, section 151.72. This will allow time for the City to research and determine how to proceed <br />in appropriately regulating the products. <br />City Staff is in the process of researching the issue to provide guidance on the new law, and will bring <br />recommendations to the Council based on guidance from the League of Minnesota Cities and the City Attorney. <br />Should the Council choose to implement the interim ordinance; staff will directly contact retailers in the City <br />that would be impacted so they are aware of the interim ordinance being in affect. <br />RECOMMENDATION <br />Staff recommends approval. <br />ATTACHMENTS: <br />Interim Ordinance
