March 28, 2023 <br />Page 4 <br />Other Items. <br />The staff recommended a change to the manner in which enforcement could deal with those doing <br />work, or having done work, without a required zoning permit. The recommendation has been to mirror <br />the allowances of the Building Code process, which is to allow the imposition of double fees, prior to a <br />need to issue a violation tag. The staff’s process is to work extensively with those who are found to <br />have undertaken such work without permitting, and provide an opportunity to correct the lack of permit <br />without penalty. The double fee option creates an enforcement option that can be applied when <br />property owners choose not to voluntarily comply, and hopefully, it provides an incentive to obtain <br />permits when notified. This change was added to the recently adopted fee schedule, but is now <br />proposed to be added to the penalty clause (Section 10.99) or the City Code to match the schedule. <br />The second item relates to residential garbage container enclosures. The City created a carve-out for <br />residents to store containers in the front portion of their property under certain conditions, including <br />the screening of the containers with a “solid screen”. There have been objections to this language from <br />residents who are proposing to construct reasonable screening structures, but which have limited gaps <br />between the materials. Staff believes that language amount to a gap of approximately 1 inch between <br />boards of the screening structure would fulfill the intent of the code, and provide some flexibility for <br />residents, and would bring this amendment forward with the next set of ordinances. <br />Related to this item is concerns that the size limitations created by the adopted code have been found <br />to raise issues for some residents in fitting all containers in the enclosure. Especially with the current <br />change in trash collection contractor, this comment has been raised. We would proposed to research <br />this issue again, and modify the dimensions in the code to accommodate the dominant sized containers. <br />8
