ORDINANCE 2023-03 ___ <br /> <br />5 <br /> <br /> <br />(1) For external or internal use in the diagnosis, cure, mitigation, treatment, or <br />prevention of disease in humans or animals; or <br /> <br />(2) To affect the structure or any function of the bodies of humans or other animals. <br /> <br />(C) No product containing any cannabinoid or tetrahydrocannabinol extracted or <br />otherwise derived from hemp may be sold to any individual who is under the age of <br />21. <br /> <br />(D) Products that meet the requirements of this section are not controlled substances <br />under Minn. Stat.§ 152.02. <br /> <br />(E) Testing Requirements. All testing must comply with the requirements set forth in <br />Minn. Stat. § 151.72, Subd. 4, as may be amended. <br /> <br />(F) Labeling Requirements. All labeling must comply with the requirements set forth <br />in Minn. Stat. § 151.72, Subd. 5, as may be amended. <br /> <br />(G) Eligible Licensed Establishments. Only the following establishments shall be <br />eligible to apply for or receive a license from the City for the sales of products <br />subject to this Section in one of three categories. <br />a. City-Licensed Off-sale Retail Liquor Establishments. This category of <br />license is limited to Municipal Liquor retail locations. The sale and <br />licensing of THC-infused edible products (both solid and beverages) in <br />such establishments shall be subject to the regulations of this Section, as <br />well as to all of the same requirements of the Liquor License and City <br />Codes regulating such licensing, including St. Anthony City Code Chapter <br />112. <br />b. City-Licensed On-sale Retail Liquor Establishments. The sale and licensing of THC- <br />infused edible products (exclusively limited to THC-infused beverages) as an <br />accessory use. Such establishments shall be subject to the regulations of this Section, <br />as well as to all of the same requirements of the Liquor License and City Codes <br />regulating such licensing, including St. Anthony City Code Chapter 112. <br />a.c. City-Licensed Tobacco retail establishments, limited to the sale of THC-infused <br />edible products limited to solids as defined herein as an accessory use, and <br />expressly excluding beverages. The sale and licensing of THC-infused products <br />in such establishments shall be subject to the regulations of this Section, as well <br />as to all of the same requirements of the Tobacco License and City Codes <br />regulating such licensing, including St. Anthony City Code Section 111.045 – <br />111.057. <br /> <br />Section 111.165. Additional Requirements for Edible Cannabinoid Products. In accordance with <br />Minn.
