Chapter 114. Mobile Food Units (Food Trucks) <br />§ 114.01 PURPOSE. <br /> This chapter is enacted to permit the reasonable use of mobile food units while preventing any <br />adverse consequences to residents, businesses, and public property. <br />§ 114.02 DEFINITIONS. <br /> For the purpose of this chapter, the following definition shall apply unless the context clearly <br />indicates or requires a different meaning. <br /> MOBILE FOOD UNIT. Mobile food unit means a food and beverage service establishment <br />that is a vehicle mounted unit, either: <br />(1) Motorized or trailered, operating no more than 21 days annually at any one place, or <br />operating more than 21 days annually at any one place with the approval of the regulatory <br />authority as defined in Minn. Rules, Part 4626.0020, Subpart 70; or <br />(2) Operated in conjunction with a permanent business licensed under M.S. Chapters 28A or <br />157 at the site of the permanent business by the same individual or company, and readily <br />movable, without disassembling, for transport to another location. <br />§ 114.03 LICENSING. <br />(A) State and county license required. No person shall operate a mobile food unit within <br />the city limits without first having obtained the appropriate license from the state or <br />county as may be required by M.S. Chapter 329, as it may be amended from time to time, <br />or as may be required under any other applicable state statute, rule, or regulation. <br />(B) City license required. Except as otherwise provided by this chapter, no person shall <br />operate a mobile food unit without first obtaining a city license. A license to operate a <br />mobile food unit shall be issued pursuant to, and the operation of a mobile food unit shall <br />be regulated by this chapter and not by Chapter __(Transient Merchant)__ of this code. <br />(C) Application. An application for a city license to operate a mobile food unit shall be <br />made at least 14 regular business days before the applicant desires to begin operating a <br />mobile food unit within the city. Application for a license shall be made on a form <br />approved by the City Council and available from the office of the City Clerk. Any fraud, <br />misrepresentation, or false statement on the application shall constitute a violation of this <br />chapter and shall be grounds for denial of the license application. All applications shall <br />be signed by the applicant. <br /> (D) All applications shall include the following information: <br /> (1) The applicant's full legal name;
