MEMORANDUM <br />To:Mayor Stille and St. Anthony Village City Council <br />From:Stephen Grittman, City Planner <br />Date:August 3, 2023 <br />Meeting Date:August 8, 2023 <br />RE:St. Anthony – Cannabis Business Interim Ordinance <br />GC Project No.140-00 <br />BACKGROUND AND ANALYSIS <br />This memorandum forwards an interim ordinance establishing a moratorium on the use of land <br />for sales, manufacturing, or distribution of cannabis products within the Village. As you are <br />likely aware, the State Legislature authorized both personal use and business activities related <br />to cannabis products in its 2023 session. <br />The ordinance is to be considered following a public hearing, which has been noticed for this <br />meeting date. <br />Personal use (including use, possession, and growing) of these products became legal <br />throughout the state on August 1. The relevant statute authorized personal use in specific <br />areas, and prohibited it others, although Cities are left to regulate a variety of public places <br />separately. <br />The statute also authorizes business activities related to sales, manufacturing and distribution <br />of cannabis. However, these activities will be licensed through a new state “Office of Cannabis <br />Management”, which is still being established and staffed. As such, business activities are not <br />expected to begin prior to January 1, 2025. As such, the proposed interim ordinance <br />establishes a local moratorium through that date, allowing St. Anthony to study the land use <br />and public health issues related to the new law, and create relevant regulations around <br />businesses that may seek a St. Anthony location. <br />Just to be clear, the interim ordinance addresses business aspects of cannabis only – the <br />personal use issues are not subject to the moratorium.
