CITY OF ST. ANTHONY VILLAGE STATE OF MINNESOTA RESOLUTION 23-045 A RESOLUTION APPROVING SUMMARY PUBLICATION FOR ORDINANCE 2023-04 WHEREAS, the City Council of the City of St. Anthony has adopted the above referenced ordinance concerning granting CenterPoint Energy Resources Corp. and its successor and assigns, a nonexclusive franchise to construct, operate, repair and maintain facilities and equipment for the transportation distribution, manufacture and sale of gas energy for public and private use and to use the public ways and ground of the city of St. Anthony, Minnesota, for such purpose; and, prescribing certain terms and conditions thereof; and WHEREAS, Minnesota Statutes, section 412.191, subdivision 4 allows publication by title and summary in the case of lengthy ordinances or those containing maps or charts; and WHEREAS, the City Council believes that the following summary would clearly inform the public of the intent of Ordinance 2023-04 NOW, THEREFORE, BE IT RESOLVED that: the following summary of Ordinance 2023-04 shall be published in the official paper in lieu of the entire ordinance. SUMMARY PUBLICATION Ordinance 2023-04 AN ORDINANCE GRANTING CENTERPOINT ENERGY RESOURCES CORP., d/b/a CENTERPOINT ENERGY MINNESOTA GAS ("CENTERPOINT ENERGY"), ITS SUCCESSORS AND ASSIGNS, A NON-EXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE, REPAIR AND MAINTAIN A GAS DISTRIBUTION SYTEM INCLUDING NECESSARY GAS MAINS, PIPES AND EQUIPMENT FOR THE TRANSPORTATION, DISTRIBUTION AND SALE OF GAS FOR PUBLIC AND PRIVATE USE AND TO USE PUBLIC WAYS AND PUBLIC GROUNDS OF THE CITY OF ST. ANTHONY FOR SUCH PURPOSES; AND PRESCRIBING CERTAIN TERMS AND CONDITIONS THEREOF. The following is the official summary of Ordinance 2023-04 approved by the St. Anthony City Council on July 25, 2023 . The purposed of the ordinance is to grant to CenterPoint Energy a twenty (20) year non-exclusive franchise to operate, repair and maintain a natural gas distribution system within the city limits of the City of St. Anthony. The terms and conditions of service and the rates to be charged by CenterPoint Energy for natural gas energy are subject to the exclusive jurisdiction of the Minnesota Public Utilities Commission. The ordinance provides for a method of dispute resolution if either the City of St. Anthony or CenterPoint Energy asserts that the other party has defaulted in the terms of the gas franchise ordinance. The ordinance provides that all gas facilities shall be located, constructed, and maintained so as not to interfere with the safety and convenience of ordinary travel along and over public ways. The ordinance also provides that CenterPoint Energy shall indemnify and hold the City of St. Anthony harmless from liability on account of injury to persons or damage to property occasioned by the construction, maintenance, repair, inspection, the issuance of permits, or the operations of the Gas Facilities located in the City of St. Anthony's public rights of way and public grounds.
