City Council Meeting - October 10, 2023 <br />Page 6 <br /> <br /> <br />Summary and Council Action <br />As highlighted above, the attached ordinance follows the “nuisance” approach to the smoking <br />issue, prohibiting cannabis use in specific public spaces, and incorporates a companion <br />prohibition of tobacco smoking in those same spaces. This expands the City’s current <br />regulation of tobacco smoking from indoor spaces to those identified outdoor spaces. The <br />ordinance refrains from expanding the prohibition to all outdoor public spaces, such as public <br />sidewalks along roadways, etc. Tobacco and cannabis smoking would be legal in these <br />locations, although alcohol use in those areas would continue to be prohibited by state law. It <br />further refrains from extending the prohibition to privately -owned quasi-public spaces (such as <br />restaurant patios) as some communities have done. Of course, the individual property owner <br />has the right to prohibit smoking – tobacco and/or cannabis - on its own property. <br />Council Action: <br />If the Council agrees with the approach and scope, staff recommends adoption of the attached <br />Ordinance 2023-06 <br /> <br /> <br />For additional background and reference, the City’s Codes related to Tobacco are located in <br />Section 111.045-111.059, and Alcohol in Section 112.
