MEMORANDUM <br />To:Mayor Stille and St. Anthony Village City Council <br />From:Stephen Grittman, City Planner <br />Date:November 21, 2023 <br />Meeting Date:November 28, 2023 <br />RE:St. Anthony – Cannabis Use on Public Property <br />GC Project No.140.00 <br />BACKGROUND AND COUNCIL ACTION <br />The information below is the staff discussion that framed the City Council’s initial reading of a <br />smoking ban in public parks and on public property including the City Hall, Fire Station, and Public <br />Works properties. The Council approved the first reading of the attached ordinance at its October <br />10, 2023 meeting. The second reading was passed by the Council at its meeting on November 14. <br />Summary and Council Action <br />As highlighted in prior reports, the attached ordinance follows the “nuisance” approach to the <br />smoking issue, prohibiting cannabis use in specific public spaces, and incorporates a companion <br />prohibition of tobacco smoking in those same spaces. This expands the City’s current <br />regulation of tobacco smoking from indoor spaces to those identified outdoor spaces. The <br />ordinance refrains from expanding the prohibition to all outdoor public spaces, such as public <br />sidewalks along roadways, etc. Tobacco and cannabis smoking would be legal in these <br />locations, although alcohol use in those areas would continue to be prohibited by state law. It <br />further refrains from extending the prohibition to privately-owned quasi-public spaces (such as <br />restaurant patios) as some communities have done. Of course, the individual property owner <br />has the right to prohibit smoking – tobacco and/or cannabis - on its own property. <br />Requested Council Action: Approve the Third (Final) Reading of an Ordinance Amendment <br />prohibiting smoking on certain public property, per the attached Ordinance No. 2023-06.
