ORDINANCE NO. 2023-06 <br />1 <br />CITY OF ST. ANTHONY <br />HENNEPIN AND RAMSEY COUNTY, MINNESOTA <br />AN ORDINANCE AMENDING THE ST. ANTHONY CITY CODE, BY <br />AMENDING TITLE XI, SECTION 111 RELATING TO REGULATION OF <br />SMOKING IN PUBLIC PLACES <br />THE CITY COUNCIL OF THE CITY OF ST. ANTHONY HEREBY ORDAINS: <br />Section 1.Section §111.046 is hereby amended to add the following: <br />§111.046 Definitions. <br />PUBLIC PLACE, OUTDOOR. All City and County parks; parking lots adjacent to such <br />parks; trails within City parks; on the main city campus - including City Hall and fire station; <br />on other City-owned property including the Public Works maintenance facility; and adjacent <br />parking lots to each of these facilities. <br />. <br />SMOKING. Inhaling, exhaling, burning, or carrying any lighted or heated cigar, <br />cigarette, or pipe, or any other lighted or heated product containing, made, or derived <br />from nicotine, tobacco, marijuana, cannabis, hemp, or other plant, whether natural or <br />synthetic, that is intended for inhalation. Smoking also includes carrying or using an <br />activated electronic delivery device. <br />CANNABIS OR MARIJUANA. For purposes of this section, the terms CANNABIS <br />or MARIJUANA shall include “cannabis flower,” “cannabis products,” “lower-potency <br />hemp edibles,” and “hemp-derived consumer products” and shall have the definitions <br />given to them in Minnesota Statutes, section 342.01, as it may be amended from time to <br />time. <br />Section 2. Section § 111.059 is hereby amended to read as follows: <br />§ 111.059 SMOKING PROHIBITED. <br />Smoking is prohibited, and no person shall smoke in a public place, in a public place, <br />outdoor as herein defined, at a public meeting, in a place of employment, or in public <br />transportation. <br />Section 3.The City Clerk is hereby directed to make the changes required by this Ordinance <br />as part of the Official St. Anthony City Code, Title XI, and to renumber the tables <br />and chapters accordingly as necessary to provide the intended effect of this <br />Ordinance. The City Clerk is further directed to make necessary corrections to <br />any internal citations that result from said renumbering process, provided that <br />such changes retain the purpose and intent of the Zoning Ordinance as has been
