City Council Regular Meeting Minutes <br />November 28, 2023 <br />Page 6 <br />1 <br />2 Motion by Councilmember Jenson, seconded by Councilmember Walker, for approval Second <br />3 Reading of Ordinance 2023-10 – Amending Multiple Sections of Chapter 33 Sewer, Water, <br />4 License and Permit Fees, Stormwater Facilities. <br />5 <br />6 Motion carried 4-0. <br />7 <br />G.8 Ordinance 2023-06 – Amending the St. Anthony City Code, by Amending Title XI, <br />9 Section 111 Relating to Regulation of Smoking in Outdoor Public Places. <br />10 <br />11 City Planner Steve Grittman reviewed the ordinance follows the “nuisance” approach to the <br />12 smoking issue, prohibiting cannabis use in specific public spaces, and incorporates a companion <br />13 prohibition of tobacco smoking in those same spaces. This expands the City’s current regulation <br />14 of tobacco smoking from indoor spaces to those identified outdoor spaces. The ordinance <br />15 refrains from expanding the prohibition to all outdoor public spaces, such as public sidewalks <br />16 along roadways, etc. Tobacco and cannabis smoking would be legal in these locations, although <br />17 alcohol use in those areas would continue to be prohibited by State law. It further refrains from <br />18 extending the prohibition to privately-owned quasi-public spaces (such as restaurant patios) as <br />19 some communities have done. The individual property owner has the right to prohibit smoking – <br />20 tobacco and/or cannabis – on its own property. <br />21 <br />22 Council is requested to approve the Third and Final Reading of an Ordinance Amendment <br />23 prohibiting smoking on certain public property, per Ordinance No. 2023-06. <br />24 <br />25 Motion by Councilmember Walker, seconded by Councilmember Webster, for approval of Third <br />26 and Final Reading and Adoption of Ordinance 2023-06 – Amending the St. Anthony City Code, <br />27 by Amending Title XI, Section 111 Relating to Regulation of Smoking in Outdoor Public Places. <br />28 <br />29 Motion carried 4-0. <br />30 <br />H.31 Resolution 23-067 – Approving Summary Publication of Ordinance 2023-067. <br />32 <br />33 City Manager Yunker reviewed this resolution is for approval of a summary publication of <br />34 Ordinance 2023-06. <br />35 <br />36 Motion by Councilmember Webster, seconded by Councilmember Walker, for approval of <br />37 Resolution 23-067 – Approving Summary Publication of Ordinance 2023-06. <br />38 <br />39 Motion carried 4-0. <br />40 <br />41 VII.REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. <br />42 <br />43 City Manager Yunker had no report. <br />44 <br />45 Councilmember Webster had no report. <br />46 <br />12
