City Council Regular Meeting Minutes <br />December 12, 2023 <br />Page 4 <br />1 Mayor Stille asked how this plan will roll out. City Manager Yunker reviewed some of the <br />2 Action Steps. The Plan has a scope of 3-5 years timeframe. This will be further discussed during <br />3 Goal Setting in January 2024. Mayor Stille noted St. Anthony has always been a leader in this. <br />4 <br />5 Motion by Councilmember Randle, seconded by Councilmember Jenson, to adopt the Climate <br />6 Plan as presented. <br />7 <br />8 Motion carried 5-0. <br />9 <br />10 VI.GENERAL BUSINESS OF COUNCIL. <br />11 <br />A.12 Resolution 23-076 – Approving a Third Amendment to Contract for Redevelopment with <br />13 Doran SLV, LLC. <br />14 <br />15 City Manager Charlie Yunker reviewed Council is requested to consider a resolution approving a <br />16 Third Amendment to Contract for Redevelopment with Doran SLV, LLC for the former Walmart <br />17 site redevelopment, referred to as The Ruby. <br />18 <br />19 The initial Contract for Private Redevelopment contemplated the construction of each phase of <br />20 our Ruby project to be done in two phases. A Second Amendment was requested and <br />21 subsequently approved, which changed the improvement construction commencement and <br />22 completion dates given uncertainties with the recent pandemic. <br />23 <br />24 Doran SLV, LLC is requesting Council consent to the Third Amendment to do two things: <br />1.25 Confirm the City agrees that Doran has met the terms of completion for the first Phase, per <br />26 the Completion of Phase I Minimum Improvements based on the issuance of a Certificate of <br />27 Occupancy in December 2022, and <br />2.28 Request an extension of timing requirements on Phase 2. In Section 2(a) of the amendment, <br />29 Doran SLV, LLC proposes Phase II Commencement deadline of January 1, 2025 and <br />30 completion date of January 1, 2027. <br />31 <br />32 Mr. Evan Doran (participating from Dorn SLV, LLC on zoom) was not able to be heard due to <br />33 technical difficulties. Mr. Doran stated he does not have a lot to add to Mr. Yunker’s report. He <br />34 explained the content of the Third Amendment. He stated a lot of time and energy is being spent <br />35 on this project. <br />36 <br />37 Councilmember Walker asked if the request for extension is time-sensitive because there will be <br />38 a transition of Mayor for St. Anthony. Mr. Dorn stated they are technically out of compliance on <br />39 the commencement date and he would prefer not to have the question if Phase 1 is complete. The <br />40 building is occupied and has been for over a year. <br />41 <br />42 Mayor Stille asked about common areas and that would be a show of commitment for the <br />43 project. Mr. Doran stated the clubhouse is complete and the amenities deck is complete for the <br />44 most part (90%). Mr. Doran stated there is near 90% leased. <br />45 <br />14
