MEMORANDUM <br />To:Mayor Webster and St. Anthony Village City Council <br />From:Stephen Grittman, City Planner <br />Date:City Council Meeting – March 26, 2024 <br />GC Project No.140.01 – 24.03 <br />Request:Request for a Conditional Use Permit for a Temporary Structure (Garden <br />Center) in a PUD, Planned Unit Development District <br />Property Address:3930 Silver Lake Road NE <br />Property PID:31-30-23-31-0029 <br />REQUESTED COUNCIL ACTION <br />Consideration of adoption of Resolution 24-024 approving a Conditional Use Permit for a <br />Seasonal Garden Center at 3930 Silver Lake Road NE per the requirements of said Resolution, <br />including the findings of fact and conditions of approval. <br />PLANNING COMMISSION ACTION <br />The Planning Commission considered the proposed Conditional Use Permit at a public hearing <br />during its regular meeting on March 19, 2024. The applicant/operator was not present at the <br />meeting to answer questions from the Commission, nor were other members of the public. <br />The Commission discussed the proposed use, noting that it had existed largely in the same <br />location and nature of operation in previous years, without apparent incident or issue. The <br />Commission discussed location and circulation on the site. The Commission further discussed <br />restroom facilities available to employees of the facility. Staff indicated that the applicant is the <br />tenant on the subject property – Cub Foods, which can grant approval for the garden center <br />operator and its employees to utilize store facilities. The Commission noted that any future <br />utilization of temporary portable restroom facilities would require staff approval, presuming <br />compliance with the requirements of City Code. <br />Following discussion, the Commission voted unanimously to recommend approval of the <br />Conditional Use Permit with the conditions identified in the staff report (see below). The <br />conditions have been expanded slightly to express the Commission’s recommendation that <br />staff would have the authority to approve any future request for portable restroom locations if <br />such a facility were to be needed. <br />39
