City Council Regular Meeting Minutes <br />March 12, 2024 <br />Page 3 <br />1 the proposed ordinance to the City Council with changes to the proposed text as noted in the <br />2 redline draft. <br />3 <br />4 Mr. Grittman summarized the Proposed Ordinance Sections: <br />5 <br />6 Section 1 – Consolidates a variety of limits for outdoor noise generation to a consistent time, <br />7 requiring no excessive noise creation between 9:00 p.m. and 7:00 a.m. <br />8 <br />9 Section 2 – Establishes a more quantifiable definition for landscape screening when it is required <br />10 by either the Code or by Council action. <br />11 <br />12 Section 3 – Deletes parking references from the Nuisance section (these parking requirements <br />13 were updated and established as a separate section in a prior amendment, not codified as Section <br />14 152.179). <br />15 <br />16 Section 4 – Creates a definition for “rodents”, which are then regulated in the subsequent <br />17 sections. NOTE: the language was taken from other code examples – the Commission discusse3d <br />18 the inclusion of chipmunks and squirrels in the list and recommended no change. <br />19 <br />20 Section 5 – Adds a prohibition on rodent harborage for Owner/Landlords. <br />21 <br />22 Section 6 – Adds a prohibition on rodent harborage for renter/occupants. <br />23 <br />24 Section 7 – Moves Nuisance Automobile language into a related public health nuisance section. <br />25 <br />26 Section 8 – Adds a process requirement for Abandoned Sign removal (currently there is a <br />27 definition and prohibition, but no specific consequence). <br />28 <br />29 Section 9 – Adds a specific allowance for refuse container screening structures – not allowed in <br />30 the front yard – to be constructed of prefabricated materials, rather than the prior inference that <br />31 they be custom-built. <br />32 <br />33 Section 10 and 11 – Consolidates adult- and child-care centers a Conditional Use in the C, <br />34 Commercial and LI, Light Industrial Districts – current language is inconsistent. <br />35 <br />36 Sections 12 and 13 – Adoption/Admin language. <br />37 <br />38 Councilmember Jenson read through the changes and asked if all was reviewed by the Planning <br />39 Commission and Mr. Grittman stated the Planning Commission did review all. <br />40 <br />41 Councilmember Stephens asked what portion are changes from the residents and Mr. Grittman <br />42 stated there were no public comments received. <br />43 <br />44 Councilmember Doolan referred to Section 1 on the noise ordinance and there was discussion at <br />45 the Planning Commission Meeting for changing the time from 10:00 p.m. Mr. Grittman stated <br />7
