Planning Commission Regular Meeting Minutes <br />March 19, 2024 <br />Page 4 <br />1 front access road. Zoning Code was created to allow for these types of uses with a Conditional <br />2 Use Permit. Mr. Grittman stated the loss of parking spaces does not appear to be an issue. <br />3 <br />4 Temporary structures such as this are specifically allowed as Conditional Uses, with a series <br />5 of conditions that relate to the site conditions and requirements for the facility, including <br />6 duration, signage, and other operational elements. <br />7 <br />8 Mr. Grittman reviewed Zoning Ordinance Section 152.190(F). The proposed garden center is <br />9 proposed to be within a fenced enclosure shown as approximately 152 feet in length by 36 <br />10 feet in width. A temporary greenhouse approximately 60 feet long by 21 feet wide <br />11 (approximately 1,260 sf) is located within the enclosed area, which is otherwise occupied by <br />12 display of garden plants and materials. The site has been utilized in this manner on a seasonal <br />13 basis in prior years and the proposed site plan for the current application utilizes the same <br />14 layout and location. The site occupies 2 ranks of parking in the existing parking lot. As <br />15 situated, the existing drive aisles would remain unobstructed. The store owner has <br />16 collaborated with the applicant and there is no expectation that the proposed location or layout <br />17 would create problems for either the site, or for public services that may be needed. <br />18 <br />19 The applicant should identify how the site will be served for restroom purposes and whether <br />20 the employees will have access to facilities in permanent businesses on the site. If a temporary <br />21 restroom facility will be located to comply with the intent of Section 152.190 (E) to ensure <br />22 that it is placed in the least visible location. <br />23 <br />24 Signage for the facility will consist of “wall” signage location over the entrance, and on the <br />25 side walls of the temporary structure. No freestanding signage is proposed. As part of the <br />26 ongoing operational aspects of the use, the applicant should verify compliance with the <br />27 duration (180 days), and any other requirements, including those of the fire department <br />28 officials. <br />29 <br />30 Staff recommends approval with the following conditions: <br />1.31 Issues related to building, fire, and other related city codes shall be subject to comment <br />32 and recommendation by applicable staff. <br />33 <br />2.34 The applicant receives, and provides to the City, operational information related to utility <br />35 services and any details related to use and location of portable restroom facilities on the <br />36 premises. <br />37 <br />3.38 The CUP is provided for the requested site only. Changes in location, size, operation, or <br />39 other aspects of the facility will require a new CUP application. The CUP, per the <br />40 allowances of the Zoning Ordinance relating to Temporary Structures, remains valid for <br />41 the location and site as proposed, with need only for annual administrative review, <br />42 provided no expansion or other substantive changes are proposed. <br />43 <br />44 This recommendation is based on a finding that the proposal, with the conditions cited, is <br />45 consistent with the requirements for Conditional Use Permit consideration, with the long-term <br />46 objectives of the recommendations and policies of the St. Anthony Comprehensive Plan.
