City Council Meeting, May 14, 2024 <br />Page 2 <br />The one-way circulation change reconfigures 90 degree parking on the north and west <br />boundaries to a combination of 11 angled spaces and 5 parallel waiting spaces for pre-order <br />customers – reducing overall parking on the site by approximately 16 spaces. A small change to <br />an existing curb island is also included to manage waiting spaces at the exit portion of the site. <br />CITY COUNCIL ACTION <br />Consideration of Resolution 24-035 approving a Conditional Use Permit for modifications to a <br />drive-through facility for Culver’s at 4004 Silver Lake Road based on a finding that the proposed <br />use is consistent with the requirements of the Zoning Ordinance, incorporating the conditions <br />of approval therein. <br />STAFF AND PLANNING COMMISSION RECOMMENDATION <br />The Planning Commission reviewed the proposed Conditional Use Permit request at a public <br />hearing held on April 16, 2024. There was no one in attendance at the hearing, and no written <br />submissions were received from members of the public. The Commission queried staff on <br />details of the plan, including options for future changes if needed. The recommended terms <br />suggest that ongoing review of parking demand and supply are subject to review if needed. <br />Representatives of the applicant were present, and spoke to the changes to the site and to the <br />facility overall. They noted an increase in drive-through use, and the sufficiency of parking for <br />staff and dine-in customers. After consideration, the Planning Commission voted unanimously <br />to recommend approval of the Conditional Use Permit, with the conditions listed in the Staff <br />report. <br />Staff has reviewed the project for land use compliance with the intent and policies of the City’s <br />Comprehensive Plan, and for zoning consistency with the Commercial District as a baseline. In <br />summary, the Comprehensive Plan supports commercial uses in this area. The proposed <br />application would, with appropriate conditions, facilitate that purpose for the subject property. <br />However, there are conditions that staff has recommended to mitigate or clarify potential <br />impacts from the revised plan.
