Jones and Mike Mayne <br />Silver Lake Association <br /> <br />Rice Creek Watershed District <br />Matt Kocian <br /> <br />Dear Mr. Jones and Mr. Mayne, <br />This variance letter is in response to the Silver Lake Association request to treat Silver Lake (DOW#62008300) <br />with the herbicide fluridone to target Eurasian watermilfoil on a lakewide level. A variance from the MnDNR is <br />required to treat > 15% of the littoral area. The management goals of this variance are to reduce curly-leaf <br />pondweed lakewide and improve the native plant community. <br /> <br />With this variance, the DNR may issue an Invasive Aquatic Plant Management permit for Eurasian watermilfoil <br />beyond the 15% littoral limit. This variance does not preclude the requirements of applying for and obtaining <br />aquatic vegetation control permits (APM permits) and the necessary posting requirements as described in <br />Minnesota Rule chapter 6280. <br /> <br />Please note the following variance conditions: <br />1. This variance is good for 3 years and is nontransferable. If such practices are failing to achieve their <br />goals or are having a detrimental impact, this variance may be modified. Annual evaluation and review <br />of management outcomes will occur between cooperators and MnDNR to determine effects on the <br />invasive and native plant community. <br />2. Herbicide concentration monitoring of fluridone on day of treatment and periodically monitoring for <br />30+ days after treatment. The DNR will provide sampling sites and monitoring schedule. Applicant <br />and/or applicator will be responsible for submitting samples to SePRO. <br />3. A pre-treatment delineation by a third party consultant is required. Pre-treatment delineations must <br />be whole-lake and occur in the early spring before treatment. A map must be submitted to the MnDNR <br />prior to treatment. If the map shows insufficient data to support a whole lake treatment of Eurasian <br />watermilfoil, than a variance will not be granted. <br />4. Plant monitoring by DNR, including a post-treatment point-intercept survey for three years. If DNR is <br />unable to complete these surveys in subsequent years, the applicant will be responsible to contract out <br />these surveys. <br />5. No nearshore APM treatments of offshore invasive plants are allowed with this variance.
