ORDINANCE NO. 2024-03 <br />CITY OF ST. ANTHONY <br />HENNEPIN AND RAMSEY COUNTY, MINNESOTA <br />AN ORDINANCE AMENDING THE ST. ANTHONY CITY CODE, BY <br />AMENDING TITLE XI, SECTION 152.188 RELATING TO REGULATION OF <br />THE SALE AND DISTRIBUTION OF CANNABIS PRODUCTS <br />THE CITY COUNCIL OF THE CITY OF ST. ANTHONY HEREBY ORDAINS: <br />Section 1.Section §152.088 is hereby amended to read as follows: <br />152.188 CANNABIS FACILITIES (AKA MARIJUANA DISPENSARY) <br />(A) Except as specifically provided for in this Section, Cannabis Facilities are prohibited <br />in all districts. <br />(B) The prohibition on Cannabis Facilities shall not be construed to prohibit any health <br />care practitioner from writing a prescription for medical cannabis or any patient or <br />registered designated caregiver from possessing and administering medical cannabis in <br />compliance with the law. <br />(C) Where allowed by a C, Commercial of LI, Light Industrial District, and when <br />specifically licensed by the State of Minnesota, Cannabis retail sales facilities shall meet <br />the following separation distances, as measured by the closest point of a parcel on which <br />a cannabis facility is located to the closest point of a parcel on which any of the following <br />land uses are located: <br />1) Public or Private School as licensed by the State of Minnesota for such <br />purpose, with any or all grades from Kindergarten through Grade 12, a distance of <br />1,000 feet must be maintained. <br />2) Public Parks, limited to Central Park, Emerald Park, Silver Point Park, Trillium <br />Park, and Water Tower Park, a distance of 500 feet must be maintained. <br />3) Childcare Facilities, as licensed by either the State of Minnesota or the <br />respective County in which the facility is located, no cannabis facility with any <br />retail license shall be located on any parcel which is less than 300 feet from the <br />parcel on which the licensed childcare facility is located, or the tenant space <br />occupied by the licensed childcare facility and/or its appurtenant uses if located in <br />a multi-tenant building. <br />4) Residential Substance Abuse Treatment Facilities, when properly licensed by <br />the State of Minnesota, no cannabis facility with any retail license shall be located <br />on any parcel which is less than 300 feet from the parcel on which the licensed <br />treatment facility is located, or the tenant space occupied by the licensed <br />treatment facility and/or its appurtenant uses if located in a multi-tenant building. <br />88
