Background <br />The applicant proposes to upgrade their current ground sign at the subject property along Belden <br />Drive between 33rd Avenue NE and Hilldale Avenue: <br />The new sign would be located in the existing structure and base, but would replace the current <br />changeable copy message area with the digital display. No external dimensions would change. <br />The Dynamic Display will be 12 square feet (6 feet wide by 2 feet high), which is significantly less <br />than 35% of the total allowable 150 square feet in the ROS District. The total sign display area, <br />including both the digital and non-digital surface, appears to be less than 20 square feet, well within <br />the allowance of 34 square feet for ground signs. <br />2. Dynamic Displays for institutional (or “quasi-public”) uses in the R-1 District are further subject to <br />these additional requirements: <br />• Percentage of allowable sign area for district: 35% <br />• Minimum duration of continuous image: 8 Seconds <br />• Transitions: Image changes must be instantaneous, without special effects or gradual <br />transitions <br />• Messages: Must be complete with each image, not continuing in context or intent to <br />the next images <br />• Color: Must be monochromatic against a solid black background <br />The physical dimensions of the proposed sign are within all requirements of the relevant zoning <br />restrictions. The operational aspects (transition, duration, messaging, and color) are ongoing <br />regulatory requirements of the sign. <br />The zoning ordinance requires such signs to be no closer than 15 feet to the curb. From aerial <br />photography, the sign location appears to be approximately 22 feet from the curb line of 33rd <br />Avenue, meeting the location requirement. <br />3. Applicable Code Sections. <br />Title XV Land Usage, Chapter 154 Zoning Code, Section §154.243 establishes the process and <br />findings required for consideration of Conditional Use Permits.
