Planning Commission Regular Meeting Minutes <br />January 21, 2025 <br />Page 2 <br /> <br />If acceptable to the Commission, staff asks that the Commission make a recommendation on 1 <br />the proposed ordinance and send it to the City Council for its consideration, along with any 2 <br />recommended revisions to language or approach. Some of the proposed sections may be 3 <br />withheld for further study and research if the Commission’s review requires it. 4 <br /> 5 <br />Section 1 6 <br />This language incorporates a penalty fee clause for property owners who proceed to do work 7 <br />without the requisite zoning or other applicable permits. The Building Code (separate from 8 <br />the City Code) imposes a double-fee for those who undertake a construction project without 9 <br />the required Building Permit. This clause enables the City to set an appropriate penalty fee as 10 <br />part of the City’s fee schedule, which is typically adopted and updated on an annual basis. 11 <br /> 12 <br />Section 2 13 <br />Resets the “Retaining Wall” Definition in the fence section, changing it from “wall, 14 <br />Retailing”, for simple clarity and to track with how the term is used in the Code. The text of 15 <br />the definition does not change, with the exception that a clause is added to clarify that 16 <br />retaining walls must meet the requirements of other fences, consistent with current practice. 17 <br /> 18 <br />Section 3 19 <br />This change updates the City’s recently adopted natural landscape language to be consistent 20 <br />with the even more recently adopted State statutory language from 2024. 21 <br /> 22 <br />Section 4 23 <br />This change also relates to the natural landscapes language, removing the current prohibition 24 <br />from planting such landscapes in the right-of-way, as the City has sponsored these types of 25 <br />alternative gardens, and modifying the maximum height of such materials, increasing it from 26 <br />12 to 18 inches, also consistent with the 2024 state statutory language for managed natural 27 <br />landscapes. 28 <br /> 29 <br />Section 5 30 <br />This change deletes reference to the City’s Health Officer, which is not a designated office in 31 <br />the City. 32 <br /> 33 <br />Section 6 34 <br />This change deletes reference to the City’s Health Officer, which is not a designated office in 35 <br />the City. 36 <br /> 37 <br />Sections 7 and 8 38 <br />This is a component of the Housing Maintenance chapter of the code. Prior language dealing 39 <br />with Temporary Storage deleted a section that could have been interpreted to accommodate 40 <br />moving container or “Pods” use, whereas the original intent was to prohibit the use of storage 41 <br />and shipping containers and long-term storage structures (usually in commercial or industrial 42 <br />areas). This section redefines temporary storage specific to residential uses, then limits size to 43 <br />128 square feet, whereas industrial shipping containers are usually a minimum of 320 square 44 <br />feet. 45 <br /> 46
