MEMORANDUM <br />To:Mayor Webster and St. Anthony Village City Council <br />Charlie Yunker, City Manager <br />From:Stephen Grittman, City Planner <br />Date:City Council Meeting – April 8, 2025 <br />GC Project No.140.00 <br />Request:General Code Amendments <br />Property Address: NA <br />Property PID:NA <br />PROJECT DESCRIPTION <br />The attached ordinance presents the second reading of a series of proposed code amendments <br />for consideration and discussion. This version continues to show redlining to identify the <br />changes from current code, with yellow highlighting to identify updates made for prior versions, <br />and blue highlighting for changes since the Council’s first reading on this ordinance on March <br />25, 2025. Only the first section relating to Fees (and the ability of a permittee to request an <br />extension) required amendment per the comments made at the first reading. The code sections <br />are again summarized briefly below to assist in the Council’s discussion and review, and <br />notations are made reflecting the comments from the prior reviews. <br /> PRIOR ACTION <br />The Planning Commission held a public hearing on items specifically related to zoning actions. <br />The Commission passed many of these on for eventual adoption by the City Council, which staff <br />has prepared as a package with both zoning and general code items. <br />On March 25, 2025, the City Council held its first reading of this ordinance, following a March <br />11, 2025 worksession. <br />PROPOSED ORDINANCE SECTIONS <br />Section 1. This language incorporates a penalty fee clause for property owners who proceed to <br />do work without the requisite zoning or other applicable permits. The Building Code (separate <br />from the City Code) imposes a double-fee for those who undertake a construction project <br />without the required Building Permit. This clause enables the City to set an appropriate penalty <br />fee as a part of the City’s fee schedule, which is typically adopted and updated on an annual <br />basis.
