Description of the Request (or a separate detailed narrative explaining the project) <br />Nou Vang is the owner of Able View Senior Living and is in need of expanding his business. He has located a site in St. <br />Anthony of 37,229 SF, or .8547 acres, on Foss Road. The PIN is 313023440040. The site address is shown as two <br />possible addresses, 0 Foss Rd NE or 3765 Foss Rd NE. Mr. Vang is looking to build a new building that will consist of 34 <br />units of Assisted Living for the elderly. To allow this use on this property the city requires a Conditional Use Permit which is <br />what we are applying for. <br />We also are applying for two variances, as follows: <br />Variance #1 includes a side yard setback variance on the south property line from the required setback of 15' to a <br />proposed setback of 10' 6". The reason for the variance is due to an existing storm sewer structure the city had placed on <br />this property to collect stormwater from a neighboring property to the north. In order to work around this structure, it was <br />suggested by city staff to move our building to the south to not affect the storm structure and ask for the variance. <br />Variance #2 is to ask for a variance from the required parking for a senior living facility. The requirement is 1 stall for every <br />1.1 units and that a certain percentage of those stalls need to be provided for underground or under roof. This facility is an <br />assisted living facility, not a standard senior housing facility. As a result, the residents do not own cars, nor do they drive. <br />To provide 1.1 stalls per unit would be an abundance of parking stalls that would never get used, nor ever be needed. We <br />initially proposed 11 parking stalls on site, and due to the concern of planning commission members, have now increase <br />the parking stall count to 16 stalls. The highest amount of staff on duty at one time will be 5 so 11 of the remaining stalls is <br />intended for shift change needs along with visitors and/or deliveries. A detailed analysis of the types of senior housing that <br />are available, versus what is proposed on this site, is attached to this submittal. It also gives greater detail to the parking <br />specifics as well as compare other projects completed by the architect, along with other projects completed in St. Anthony. <br />Variance #3 is to ask for a variance from the impervious surface requirement of 50%. As a result of the concern for adding <br />more parking by the planning commission, the additional 5 staffs added has caused a 4.3% variance need for impervious <br />surface. Our impervious surface is now 54.3% and the city requirement is 50%. Planning commission indicated a <br />willingness for this minor variance in exchange for the peace of mind in having more parking on site. This was under the <br />condition that the city engineer would be accepting of this variance and that the additional impervious would not be <br />causing any negative impacts on the site in regards to drainage and ponding. We have sent this information to the city <br />engineer and have not heard back yet from them at the time of this submittal. <br />At the planning commission meeting there were also concerns by neighbors to the townhome development to the north on <br />several things of which our current submittal plans have addressed. First, is we have shown a covered trash enclosure to <br />better conceal the sites and smells from the townhome property owners. The second is that we have added a hedge along <br />the north property line to provide a visual screen between the townhome property and our development. <br />City staff also recommended changes to our plans that have been incorporated into this resubmittal.
