<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Applicable Code Language: <br /> <br />92.03 PUBLIC NUISANCES AFFECTING HEALTH. <br /> <br />(E) Accumulations of manure, refuse, other debris, or materials capable of harboring rodents, which shall include <br />the following undomesticated animals: chipmunks, groundhogs/woodchucks, lemmings, mice, moles, pocket <br />gophers, rats, shrews, squirrels, and voles. This definition shall not be read to prohibit intentional accumulations <br />of vegetative materials that are designed and maintained to provide natural food sources for wild birds, nor to <br />prohibit compost structures which are constructed and located in accordance with applicable city code; <br />(L) It shall be unlawful to keep, park, store, or abandon any motor vehicle which is not in operating condition, <br />partially dismantled, used for repair of parts or as a source of repair or replacement parts for other vehicles, <br />kept for scrapping, dismantling, or salvage of any kind, or which is not properly licensed for operation with the <br />state, pursuant to M.S. § 168B.011, Subd. 3, as it may be amended from time to time. <br />(N) Any motor vehicles described in this section constitute a hazard to the health and welfare of the residents of <br />the community in that the vehicles can harbor noxious diseases, furnish a shelter and breeding place for vermin, <br />and present physical danger to the safety and well-being of children and citizens; and vehicles containing fluids <br />which, if released into the environment, can and do cause significant health risks to the community. <br /> <br />§ 92.06 NUISANCE STORAGE. <br />(A) Declaration of nuisance. The outside storage on residentially-zoned property of materials, supplies, or <br />equipment not customarily used for residential purposes in violation of the requirements set forth below is <br />declared to be a public nuisance because it: <br />(2) Creates cluttered and otherwise unsightly areas; <br />(5) Decreases adjoining landowners’ and occupants’ enjoyment of their property and neighborhood; and <br />(6) Otherwise adversely affects property values and neighborhood patterns. <br />(B) Unlawful storage. <br />07/31/2024 02:23 PM - Richard <br />Following conversation with Charlie at Code Committee meeting, I will contact Mr Kelly and inform him that without remedy <br />to the violations we will begin steps to seek a court ordered abatement. I visited the home and the resident did not answer. <br />I took updated photos and plan to return to drop off code information flyers with specific notes to him on the infractions. <br />08/14/2024 11:50 AM - Richard <br />Composed and sent a pre-abatement letter to Mr Kelly, informing him that he would have until September 4th to either <br />become compliant or make contact with me to make arrangements for a plan of action. <br />09/05/2024 02:42 PM - Richard <br />NA and no improvement, other than the limo being gone.
