television franchise agreement terms, which will be extended if the City adopts the extension <br />ordinance: <br />A nonexclusive cable television franchise to Comcast to construct and operate a cable <br />system in the public rights-of-way to provide cable service. <br />A reservation of rights to require Comcast to obtain additional authorization from the <br />City to provide other services if allowed by applicable law. <br />A requirement that Comcast comply with all local laws and other applicable laws. <br />An authorization and requirement to serve all areas of the City, subject to density and <br />line extension requirements. <br />A requirement to provide cable service to government buildings in the City. <br />Construction standards for constructing the cable system, including underground and <br />safety requirements. <br />Technical standards and testing requirements for the cable system. <br />A provision allowing the City to regulate the rates of the cable operator to the extent <br />allowed by applicable law. Current applicable law does not allow such rate <br />regulation. <br />Customer service requirements, such as addressing how non-standard installations are <br />to be handled, prohibiting deceptive sales practices, addressing subscribers questions <br />and complaints, refunds and late fees. <br />A section related to community media requirements. The City is served by Nine <br />North, a Minnesota nonprofit corporation that was created by the NSCC and member <br />cities. The cable television franchise identifies the cable television channels dedicated <br />to community media in the area. The cable television franchise identifies the signal <br />quality, channel location, remote cablecasting capabilities, community media <br />streaming, equipment and facilities support, and financial support. The financial <br />support for community media is used to fund the capital and operational expenses of <br />Nine North. Nine North provides video production and technical support to all of the <br />member cities, including city meeting coverage, unique local productions, sports <br />coverage, and public access capabilities. <br />The payment of a franchise fee in the amount of 5% of the cable operator's gross <br />revenues derived from cable service in the City. These revenues are divided between <br />the member cities and the NSCC. The NSCC addresses all regulatory and consumer <br />protection issues on behalf of the member cities and their residents. <br />Auditing authority and access to Comcast’s records. <br />29
