each of the subareas defined as <br />follows: <br />(1) Subarea 1 shall be all single- <br />family homes lying north of 37th <br />Avenue NE. <br />(2) Subarea 2 shall be all single- <br />family homes lying south of 37th <br />Avenue NE and north of 33rd <br />Avenue NE. <br />(3) Subarea 3 shall be all single- <br />family homes lying south of 33rd <br />Avenue NE and north of 29th <br />Avenue NE. <br />(4) Subarea 4 shall be all single- <br />family homes lying south of 29th <br />Avenue NE. <br />(C)(2)EXCEPTIONS. <br />a. The City Council may issue such a <br />license to an owner in a hardship <br />case for a temporary rental period <br />of up to twelve (12) months. <br />The Commission recommended an <br />alternative approach which would <br />qualify any homesteading applicant <br />an exemption from the caps on <br />rental licenses. This would permit <br />homesteaded owners under any <br />situation to convert their property <br />to rental housing. However, a <br />future buyer of the property would <br />not have this exemption, since they <br />would not meet the requirement of <br />being a homestead owner. <br />It appears that this <br />approach would <br />potentially permit any <br />number of single- <br />family homes to be <br />converted to rental <br />property, but would <br />restrict the sale of <br />rental housing to <br />homesteading buyers <br />only. <br />COUNCIL ACTION <br />For worksession purposes, Staff is seeking direction for ordinance development and presentation to the <br />City Council for consideration and adoption. <br />ATTACHMENTS <br />Draft informal ordinance
